  1                                        AN ACT
  2    RELATING TO PHYSICIANS; AMENDING CHAPTER 18, TITLE  54,  IDAHO  CODE,  BY  THE
  3        ADDITION  OF  A  NEW SECTION 54-1841, IDAHO CODE, TO PROVIDE A VOLUNTEER'S
  4        LICENSE, TO SPECIFY QUALIFICATIONS, TO SET FORTH APPLICATION  REQUIREMENTS
  5        AND TO GOVERN LICENSE RENEWAL AND REVOCATION.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION  1.  That  Chapter  18,  Title 54, Idaho Code, be, and the same is
  8    hereby amended by the addition thereto of a NEW SECTION, to be known and  des-
  9    ignated as Section 54-1841, Idaho Code, and to read as follows:
                                                                        
 10        54-1841.  VOLUNTEER'S  LICENSE -- QUALIFICATIONS. (1) Upon application and
 11    qualification, the board may issue, without examination, a volunteer's license
 12    to a physician who is retired from the active practice of medicine and surgery
 13    or osteopathic medicine and surgery to enable the retired physician to provide
 14    medical services to persons who, due to age, infirmity, handicap, indigence or
 15    disability, are unable to receive regular medical treatment.
 16        (2)  (a) For purposes of this section, a physician  previously  holding  a
 17        license to practice medicine and surgery, osteopathic medicine and surgery
 18        or osteopathic medicine with active status in Idaho or another state shall
 19        be  considered  to  be  retired if, prior to the date of application for a
 20        volunteer's license:
 21             (i)   He has surrendered or allowed his license with active status to
 22             expire with the intention of ceasing to actively practice as a physi-
 23             cian for remuneration;
 24             (ii)  He has converted his license with active status  to  a  license
 25             with  inactive status with the intention of ceasing to actively prac-
 26             tice as a physician for remuneration; or
 27             (iii) He has converted his license with active or inactive status  to
 28             a  license  with  retirement  or  similar  status that proscribed the
 29             active practice of medicine and surgery or osteopathic  medicine  and
 30             surgery.
 31        (b)  A  physician  whose  license had been restricted, suspended, revoked,
 32        surrendered, resigned, converted, or allowed to lapse  or  expire  as  the
 33        result  of  disciplinary  action  or  in lieu of disciplinary action being
 34        taken shall not be eligible for a volunteer's license.
 35        (3)  An application for a volunteer's license shall include,  but  not  be
 36    limited to, the following:
 37        (a)  Verification  of  graduation from an acceptable school of medicine or
 38        an acceptable osteopathic school of medicine;
 39        (b)  Verification from  each  state  board  in  which  the  applicant  was
 40        licensed  that the applicant maintained his license in good standing with-
 41        out  disciplinary  action  that  restricted  the  applicant's  license  or
 42        resulted in the applicant's license being placed on probation,  suspended,
 43        revoked  or  being  surrendered, resigned or otherwise allowed to lapse or

  1        expire in lieu of disciplinary action;
  2        (c)  Verification that the applicant held a license in  good  standing  in
  3        Idaho  or  another  state  as  of the date upon which the physician became
  4        retired;
  5        (d)  Verification that the applicant held an active status license in good
  6        standing in Idaho or another state within five (5) years of  the  date  of
  7        application  for a volunteer's license, provided, that the board may waive
  8        the five (5) year requirement in the event that the applicant demonstrates
  9        that he possesses the knowledge and skills requisite  to the  practice  of
 10        medicine  and  surgery or osteopathic medicine and surgery by successfully
 11        completing such examinations as are required by the board; and
 12        (e)  A notarized statement from the applicant on a form prescribed by  the
 13        board,  that  the applicant will not provide any physician services to any
 14        person other than those permitted by the license and  that  the  applicant
 15        will  not  accept  any amount or form of remuneration, other than as reim-
 16        bursement for the amount of actual expenses incurred as a volunteer physi-
 17        cian, for any  physician  services  provided  under  the  authority  of  a
 18        volunteer's license.
 19        (4)  A  volunteer's  license  shall be valid for that period specified for
 20    physicians in section 54-1808, Idaho Code, and may be renewed upon application
 21    of the licensee unless the license has been revoked in  accordance  with  this
 22    section.  The  board  shall  maintain  a register of all physicians who hold a
 23    volunteer's license. The board shall not charge an  application  or  licensing
 24    fee  for issuing or renewing a volunteer's license. A volunteer's license can-
 25    not be converted to a license with active, inactive or temporary status.
 26        (5)  The board may revoke a volunteer's license upon receiving proof  sat-
 27    isfactory  to  the  board that grounds existed for enforcement or disciplinary
 28    action against the holder of a volunteer's license  under  other  sections  of
 29    this chapter or the administrative rules promulgated under this chapter.

The purpose of this legislation is to establish a fee-exempt
license for retired physicians and osteopathic physicians to
practice medicine in free or sliding fee clinics if they receive
no remuneration.

There will be no cost to the General Fund.
