  1                                        AN ACT
  2    RELATING TO THE BOARD OF HEARING AID DEALERS  AND  FITTERS;  AMENDING  SECTION
  3        54-2907,  IDAHO  CODE, TO REVISE EDUCATION REQUIREMENTS FOR LICENSE APPLI-
  4        CANTS.
                                                                        
  5    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  6        SECTION 1.  That Section 54-2907, Idaho Code, be, and the same  is  hereby
  7    amended to read as follows:
                                                                        
  8        54-2907.  LICENSE  REQUIREMENTS.  (a)  Applicants  may obtain a license by
  9    successfully passing a qualifying examination. In addition, applicants must:
 10        (1)  Be at least twenty-one (21) years of age;
 11        (2)  Be of good moral character; and
 12        (3)  Have an education equivalent to a four (4) year course in an  accred-
 13        ited high school.
 14        (b)  Applicants  shall  appear at a time, place and before such persons as
 15    the board may designate to be examined by means of written and practical tests
 16    in order to demonstrate that they are qualified to practice  the  fitting  and
 17    sale of hearing aids. The examination shall be administered as directed by the
 18    board.  Nothing  in this examination shall imply that applicants shall possess
 19    the degree of medical competence normally expected of physicians.
 20        (c)  Each applicant for a hearing aid dealer's and fitter's license  shall
 21    file an application with the board on a form provided by the bureau of occupa-
 22    tional licenses which shall include the following information:
 23        (1)  Name, home address and telephone number of the applicant;
 24        (2)  Name of present employer;
 25        (3)  Business address and telephone number;
 26        (4)  Statement of past criminal convictions and guilty pleas;
 27        (5)  Copy  Documentation  of  high  school diploma graduation or a general
 28        education diploma (GED) or the equivalent as approved by the board;
 29        (6)  Identification of any prior licensure as a hearing aid dealer or fit-
 30        ter in another state;
 31        (7)  Disclosure of suspension or revocation of any license  as  a  hearing
 32        aid dealer or fitter in any state within the previous seven (7) years;
 33        (8)  Disclosure  of any judgment in any jurisdiction against the person as
 34        a hearing aid dealer or fitter within the last seven (7) years; and
 35        (9)  Disclosure of any habitual use of drugs  or  intoxicants  to  such  a
 36        degree as to render a person unfit and unreliable to practice as a hearing
 37        aid dealer and fitter.
 38        (d)  If  the  board,  after investigation, is satisfied that the applicant
 39    meets the requirements in subsection (a) of  this  section  and  has  provided
 40    truthful responses to the information requested in subsection (c) of this sec-
 41    tion,  the  applicant  shall  be entitled to take the next regularly scheduled
 42    examination.
 43        (e)  The completed application shall be filed  with  the  board  at  least

  1    sixty  (60)  days  prior  to  the  next scheduled examination in order for the
  2    applicant to become eligible for examination.
  3        (f)  The board shall give examinations as required to permit applicants to
  4    be examined following the submission of the official form at the next examina-
  5    tion period.

                    STATEMENT  OF  PURPOSE
                           RS 14414

Amends section 54-2907(5), Idaho Code, to change the definition 
for high school equivalency.  This change will allow the Board to 
consider post-secondary education.  The Board of Hearing Aid 
Dealers and Fitters felt this was necessary in order to consider 
all educational situations in the licensure process to maintain 
the protection and the health, safety and welfare of the public. 


                        FISCAL NOTE

There is no fiscal impact on general or dedicated funds.
