]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-eighth Legislature First Regular Session - 2005IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 100 BY REVENUE AND TAXATION COMMITTEE 1 AN ACT 2 RELATING TO FIRE PROTECTION DISTRICTS; AMENDING SECTION 31-1420, IDAHO CODE, 3 TO PROVIDE THAT A FIRE PROTECTION DISTRICT MAY PURCHASE AMBULANCES AND 4 RELATED EQUIPMENT AND PAY SALARIES AND BENEFITS IF AMBULANCE SERVICE IS 5 NOT PROVIDED WITHIN THE DISTRICT AS PROVIDED IN CHAPTER 39, TITLE 31, 6 IDAHO CODE, AND TO PROVIDE THAT A FIRE PROTECTION DISTRICT IS AUTHORIZED 7 TO ENTER INTO A JOINT EXERCISE OF POWERS AGREEMENT WITH A COUNTY TO SHARE 8 EQUIPMENT AND SERVICES IF A COUNTY IS PROVIDING AMBULANCE SERVICE PURSUANT 9 TO CHAPTER 39, TITLE 31, IDAHO CODE; DECLARING AN EMERGENCY AND PROVIDING 10 RETROACTIVE APPLICATION. 11 Be It Enacted by the Legislature of the State of Idaho: 12 SECTION 1. That Section 31-1420, Idaho Code, be, and the same is hereby 13 amended to read as follows: 14 31-1420. LEVY. (1) Each year, immediately prior to the annual county levy 15 of taxes, the board of commissioners of each fire protection district, orga- 16 nized and existing under this act, may levy a tax upon all the taxable prop- 17 erty within the boundaries of such district sufficient to defray the cost of 18 equipping and maintaining the district of twenty-four hundredths percent 19 (.24%) of market value for assessment purposes, to be used for the purposes of 20 this act.and for no other purposeA fire protection district may purchase 21 ambulances and related equipment and pay salaries and benefits if ambulance 22 service is not provided within the district as provided in chapter 39, title 23 31, Idaho Code. A fire protection district is authorized to enter into a joint 24 exercise of powers agreement with a county to share equipment and services if 25 a county is providing ambulance service pursuant to chapter 39, title 31, 26 Idaho Code. The levy shall be made by resolution entered upon the minutes of 27 the board of commissioners of the fire protection district, and it shall be 28 the duty of the secretary of the district, immediately after entry of the res- 29 olution in the minutes, to transmit to the county auditor, county assessor and 30 state board of equalization certified copies of the resolution providing for 31 such levy. Said taxes shall be collected as provided by section 63-812, Idaho 32 Code. 33 (2) If two (2) or more fire protection districts consolidate into one (1) 34 district, the provisions of section 63-802, Idaho Code, shall apply to the 35 consolidated district's budget request as if the former district which, in the 36 year of the consolidation, has the higher levy subject to the limitations of 37 section 63-802, Idaho Code, had annexed the other district or districts. In 38 addition, the consolidated district shall receive the benefit of foregone 39 increases accumulated by the former districts under section 63-802(1)(a), 40 Idaho Code. 41 (3) Notwithstanding the provisions of section 63-802, Idaho Code, fire 42 protection districts adversely impacted by abnormally low levies at the time 43 of enactment of section 63-2220A, Idaho Code, and recodified as section 2 1 63-802, Idaho Code, may seek voter approval to reach a fire protection dis- 2 trict levy of twenty-four hundredths percent (.24%) of market value for 3 assessment purposes to be used for the purposes of this act and for no other 4 purpose. The additional budget amount must be approved by sixty-six and two- 5 thirds percent (66 2/3%) of the voters on the question at an election called 6 for that purpose and held on the dates provided by section 34-106, Idaho Code. 7 If approved by the voters, the additional budget amount may be included in 8 each succeeding annual budget. 9 SECTION 2. An emergency existing therefor, which emergency is hereby 10 declared to exist, this act shall be in full force and effect on and after its 11 passage and approval, and retroactively to January 1, 2005.

Said 30 taxes shall be collected as provided by section 63-812, Idaho Code. 31 (2) If two (2) or more fire protection districts consolidate into one (1) 32 district, the provisions of section 63-802, Idaho Code, shall apply to the 33 consolidated district's budget request as if the former district which, in the 34 year of the consolidation, has the higher levy subject to the limitations of 35 section 63-802, Idaho Code, had annexed the other district or districts. STATEMENT OF PURPOSE RS 14777 This legislation would allow fire protection districts to purchase ambulances and related equipment and to pay salaries and benefits if an ambulance service is not provided within the district.
