]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-eighth Legislature First Regular Session - 2005IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 101 BY TRANSPORTATION AND DEFENSE COMMITTEE 1 AN ACT 2 RELATING TO SPECIAL MOTOR VEHICLE LICENSE PLATE PROGRAMS; AMENDING CHAPTER 4, 3 TITLE 49, IDAHO CODE, BY THE ADDITION OF A NEW SECTION 49-402D, IDAHO 4 CODE, TO PROHIBIT AUTHORIZATION OF ANY SPECIAL MOTOR VEHICLE LICENSE PLATE 5 PROGRAM; DECLARING AN EMERGENCY AND PROVIDING RETROACTIVE APPLICATION. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Chapter 4, Title 49, Idaho Code, be, and the same is 8 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 9 ignated as Section 49-402D, Idaho Code, and to read as follows: 10 49-402D. PROHIBITION AGAINST AUTHORIZATION OF SPECIAL MOTOR VEHICLE 11 LICENSE PLATE PROGRAMS -- EXISTING PROGRAMS CONTINUED -- LIMITATIONS. (1) The 12 legislature finds that the authorization of special motor vehicle license 13 plate programs has been overused and has become unnecessarily burdensome in 14 its implementation. Development and maintenance of special motor vehicle 15 license plate programs is straining the limited resources of the Idaho trans- 16 portation department and its county assessor agents. 17 (2) The legislature hereby declares that beginning with the first regular 18 session of the fifty-eighth Idaho legislature meeting in 2005, authorization 19 of any special motor vehicle license plate program is hereby prohibited. Pro- 20 grams in existence as of January 1, 2005, or which begin issuance of plates on 21 January 1, 2005, shall continue as originally authorized, unless certain pro- 22 grams are discontinued by operation of law pursuant to section 49-402C, Idaho 23 Code, or unless repealed by the legislature. 24 SECTION 2. An emergency existing therefor, which emergency is hereby 25 declared to exist, this act shall be in full force and effect on and after its 26 passage and approval, and retroactively to January 1, 2005.

STATEMENT OF PURPOSE RS 14501 This legislation is to prevent further expansion of the special license plate program beyond its present status as described in Idaho Code, Chapter 4, Title 29.
