]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-eighth Legislature First Regular Session - 2005IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 138 BY BUSINESS COMMITTEE 1 AN ACT 2 RELATING TO THE BOARD OF ARCHITECTURAL EXAMINERS; AMENDING SECTION 54-312, 3 IDAHO CODE, TO PROVIDE THAT COMPENSATION OF BOARD MEMBERS SHALL BE CONSID- 4 ERED SALARY FOR PURPOSES OF PARTICIPATION IN THE PUBLIC EMPLOYEES RETIRE- 5 MENT SYSTEM. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Section 54-312, Idaho Code, be, and the same is hereby 8 amended to read as follows: 9 54-312. ARCHITECTS -- BOARD OF EXAMINERS -- POWERS AND DUTIES -- COMPEN- 10 SATION. (1) The board of architectural examiners is hereby created in the 11 department of self-governing agencies. The board of architectural examiners 12 shall consist of six (6) members, to be appointed by the governor, each of 13 whom shall be an architect, and shall have been a resident of and a lawfully 14 practicing architect within the state of Idaho for a period of at least five 15 (5) years next before his appointment. At all times the board shall have at 16 least one (1) member who is engaged primarily in professional architectural 17 education. 18 (2) The board shall have, in addition to the powers conferred elsewhere 19 in this chapter, the following powers and duties: 20 (a) To authorize, by written agreement, the bureau of occupational 21 licenses to act as its agent in its interest. 22 (b) To adopt, pursuant to the administrative procedure act, such rules as 23 the board, in its discretion, deems necessary for the administration and 24 enforcement of this chapter. 25 (c) To conduct investigations into violations of this chapter. 26 (d) The board, or its duly appointed hearing officer, shall have the 27 power in any disciplinary proceeding under this chapter, to administer 28 oaths, take depositions of witnesses within or without the state in the 29 manner provided by law in civil cases, and may apply to any district court 30 of this state for a subpoena to require the attendance of such witnesses 31 and the production of such books, records, and papers as it deems neces- 32 sary. The fees and mileage of the witnesses shall be the same as that 33 allowed in the district courts in criminal cases, which fees and mileage 34 shall be paid in the same manner as other expenses of the board are paid. 35 In any case of disobedience to, or neglect of, any subpoena or subpoena 36 duces tecum served upon any person, or the refusal of any witness to tes- 37 tify to any matter regarding which he may lawfully be interrogated, it 38 shall be the duty of any district court in this state on application by 39 the board to compel compliance with the subpoena by proceedings for con- 40 tempt, as in the case of disobedience of the requirements of a subpoena 41 issued from such court or for refusal to testify therein. The licensed 42 person accused in such proceedings shall have the same right of subpoena. 43 (e) To adopt rules requiring annual continuing education as a condition 2 1 for the renewal of licenses issued under this chapter. 2 (3) Each member of the board of architectural examiners shall be compen- 3 sated as provided by section 59-509(oi), Idaho Code.
STATEMENT OF PURPOSE RS 14724 This legislation amends section 54-312, Idaho Code, to change the compensation schedule for the Board of Architectural Examiners. This will allow members of the Board to enroll in PERSI (Public Employee Retirement System of Idaho). FISCAL NOTE There is a fiscal impact on dedicated funds of approximately $550 per year for employer contributions.
