  1                                        AN ACT
  2    RELATING TO LIQUOR BY THE DRINK LICENSES AND RACING FACILITIES; AMENDING  SEC-
  3        TION 23-953, IDAHO CODE, TO PROVIDE THAT A RACING FACILITY SHALL INCLUDE A
  4        FACILITY  THAT  HAS  BEEN AUTHORIZED BY THE COUNTY TO CONDUCT MOTOR SPORTS
  5        RACING.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION 1.  That Section 23-953, Idaho Code, be, and the  same  is  hereby
  8    amended to read as follows:
                                                                        
  9        23-953.  RACING FACILITIES -- LICENSING. Nothing contained in this chapter
 10    shall prohibit the issuance of a license to the owner, operator or lessee of a
 11    racing facility, even if situated outside the incorporated limits of a city. A
 12    "racing  facility"  means  an actual, bona fide racing facility located on not
 13    less than twenty (20) contiguous acres with permanently erected seating of not
 14    less than one thousand (1,000) capacity, and which has a  license  to  conduct
 15    pari-mutuel  racing  or  has  been  authorized  by the county to conduct motor
 16    sports racing. The provisions of section 23-910, Idaho Code,  shall  apply  to
 17    licenses  issued  under  the provisions of this section. The fees for licenses
 18    granted under the provisions of this section shall be the same as  those  pre-
 19    scribed  for golf courses as set forth in section 23-904, Idaho Code. Licenses
 20    issued under the provisions of this section are not transferable.

Statement of Purpose / Fiscal Impact



                       STATEMENT OF PURPOSE

                             RS 14759

The purpose of this legislation is to allow motor racing
facilities the same opportunity to apply for a liquor license as
is extended to race tracks and golf courses under section 23-953.


                           FISCAL NOTE

The fiscal impact to the state is a positive cash level. Based on
licenses that have to be obtained and taxed from liquor sales.
The additional revenue to the State of Idaho could be as much as
$50,000. This would be derived from licenses and taxes on the
liquor sales.
