]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-eighth Legislature First Regular Session - 2005IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 177 BY TRANSPORTATION AND DEFENSE COMMITTEE 1 AN ACT 2 RELATING TO RULES OF THE ROAD; AMENDING CHAPTER 6, TITLE 49, IDAHO CODE, BY 3 THE ADDITION OF A NEW SECTION 49-624, IDAHO CODE, TO PROVIDE FOR THE DUTY 4 OF A DRIVER OF A MOTOR VEHICLE UPON APPROACHING A STATIONARY POLICE VEHI- 5 CLE OR AN AUTHORIZED EMERGENCY VEHICLE DISPLAYING FLASHING LIGHTS AND TO 6 PROVIDE FOR THE DUTY OF A DRIVER OF A STATIONARY POLICE OR AUTHORIZED 7 EMERGENCY VEHICLE DISPLAYING FLASHING LIGHTS. 8 Be It Enacted by the Legislature of the State of Idaho: 9 SECTION 1. That Chapter 6, Title 49, Idaho Code, be, and the same is 10 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 11 ignated as Section 49-624, Idaho Code, and to read as follows: 12 49-624. DRIVER DUTY UPON APPROACHING A STATIONARY POLICE VEHICLE OR AN 13 AUTHORIZED EMERGENCY VEHICLE DISPLAYING FLASHING LIGHTS. The driver of a motor 14 vehicle, upon approaching a stationary police vehicle displaying flashing 15 lights or an authorized emergency vehicle displaying flashing lights shall: 16 (1) If the driver is traveling on a highway with two (2) or more lanes 17 carrying traffic in the same direction, immediately reduce the speed of his 18 vehicle, proceed with due caution, and change lanes as soon as it is possible 19 to do so in a manner that is reasonable and prudent under the conditions then 20 existing, with regard to actual and potential hazards. 21 (2) If the driver is traveling on a highway with one (1) lane for each 22 direction of travel, immediately reduce the speed of his vehicle, and change 23 lanes into the opposing traffic lane, but only if the opposing lane is clearly 24 visible and free of oncoming traffic for a sufficient distance ahead to permit 25 moving around the stationary vehicles and without interfering with the opera- 26 tion of any vehicle approaching from the opposite direction. The driver shall 27 return to an authorized lane of travel as soon as practicable and in all 28 respects shall operate his vehicle in a manner that is reasonable and prudent 29 under the conditions, with regard to actual and potential hazards. 30 (3) The provisions of this section shall not relieve the driver of a 31 police vehicle or an authorized emergency vehicle from the duty to drive with 32 due regard for the safety of all persons and property upon the highway.
