  1                                        AN ACT
  2    RELATING TO THE PRACTICE OF PHYSICAL THERAPY; AMENDING SECTION 54-2213,  IDAHO
  3        CODE, TO SET FORTH CONTINUING EDUCATION REQUIREMENTS FOR RENEWAL OF ACTIVE
  4        LICENSES;  AND  AMENDING  SECTION 54-2214, IDAHO CODE, TO REQUIRE PROOF OF
  5        COMPLETION OF CONTINUING EDUCATION REQUIREMENTS.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION 1.  That Section 54-2213, Idaho Code, be, and the same  is  hereby
  8    amended to read as follows:
                                                                        
  9        54-2213.  LICENSE  RENEWAL.  (1) A license shall be issued for a period of
 10    not less than one (1) year nor more than five (5) years, in  conformance  with
 11    administrative  rules  adopted  by the board. Each license shall set forth its
 12    expiration date on the face of the certificate. The failure of any licensee to
 13    renew his or her license, as required herein and by the  administrative  rules
 14    of  the board shall not deprive such person of the right to renewal, except as
 15    provided for in section 54-2214(2), Idaho Code.
 16        (2)  On and after July 1, 2007, each individual applicant for  renewal  of
 17    an  active  license  shall, on or before the expiration of the license, submit
 18    satisfactory proof to the board of successful  completion  of  not  less  than
 19    thirty-two  (32)  hours  of  board-approved continuing education every two (2)
 20    years and as set forth in administrative rules adopted pursuant to this  chap-
 21    ter.  The board, in its discretion, may require such additional evidence as is
 22    necessary to verify compliance.
 23        (3)  Fees for licensure of  physical  therapists  and  physical  therapist
 24    assistants  shall  be fixed by the board in its administrative rules. All fees
 25    shall be transmitted to the state treasurer for credit to the board's account.
 26        (34)  All licensed physical therapists or  physical  therapist  assistants
 27    shall  report  to  the  board  any name change or changes in business and home
 28    addresses prior to the expiration of thirty (30) days after the change becomes
 29    final.
                                                                        
 30        SECTION 2.  That Section 54-2214, Idaho Code, be, and the same  is  hereby
 31    amended to read as follows:
                                                                        
 32        54-2214.  REINSTATEMENT  OF LICENSE. (1) Reinstatement of a lapsed license
 33    shall require the payment of a renewal fee, satisfactory proof  of  successful
 34    completion  of  the  continuing  education  requirement  set  forth in section
 35    54-2213(2), Idaho Code, and a reinstatement fee in accordance with the  admin-
 36    istrative  rules adopted by the board, provided however, that no reinstatement
 37    fee shall be greater in amount than fifty dollars ($50.00).
 38        (2)  Reinstatement of a license that has lapsed for a period of more  than
 39    three (3) consecutive years shall require reapplying for a license and payment
 40    of  fees in accordance with the administrative rules adopted by the board. The
 41    individual shall successfully demonstrate to the board competency in the prac-

  1    tice of physical therapy. The board may also require the applicant to take  an
  2    examination, remedial courses, or both, as shall be determined by the board.

Statement of Purpose / Fiscal Impact



                       STATEMENT OF PURPOSE

                             RS 14954

This legislation would require that licensed physical therapists
and physical therapist assistants complete thirty-two (32) hours
of continuing education every two (2) years.  The legislation
also provides that a licensee, upon application for renewal of
the license to practice, submit proof of completion of the
continuing education requirement.


                           FISCAL NOTE

There will be no cost to the General Fund.
