]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-eighth Legislature First Regular Session - 2005IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 195 BY HEALTH AND WELFARE COMMITTEE 1 AN ACT 2 RELATING TO THE CHIP PLAN B HEALTH INSURANCE PROGRAM; AMENDING SECTION 56-239, 3 IDAHO CODE, TO PROVIDE LEGISLATIVE INTENT REGARDING THE CHIP PLAN B PRO- 4 GRAM, TO PROVIDE THAT THE CHIP PLAN B ADVISORY BOARD SHALL ESTABLISH AN 5 ANNUAL RESERVE AND TO PROVIDE FOR REPORTS BY THE DIRECTOR OF THE DEPART- 6 MENT OF HEALTH AND WELFARE REGARDING THE CHIP PLAN B PROGRAM. 7 Be It Enacted by the Legislature of the State of Idaho: 8 SECTION 1. That Section 56-239, Idaho Code, be, and the same is hereby 9 amended to read as follows: 10 56-239. CHIP PLAN B. (1) There is hereby created in the department a CHIP 11 Plan B that shall be made available by the department to eligible children, as 12 defined in section 56-238, Idaho Code, whose family's gross income is between 13 one hundred fifty percent (150%) and one hundred eighty-five percent (185%) of 14 the federal poverty guidelines. The director shall implement the program by 15 adopting rules recommended by the board of the Idaho high risk reinsurance 16 pool created in section 41-5502, Idaho Code, that authorize policies of health 17 insurance for children enrolled in the CHIP Plan B. 18 (2) There is hereby created a CHIP Plan B advisory board which shall 19 advise the Idaho high risk reinsurance pool board concerning issues related to 20 the CHIP Plan B. The board shall consist of eight (8) members, four (4) mem- 21 bers to be appointed by the director and four (4) members to be appointed by 22 the governor. At least two (2) members of the board shall be parents of chil- 23 dren who are eligible to participate in the CHIP Plan B. 24 (3) It is the intent of the legislature to establish a limited and dedi- 25 cated source of funding for the CHIP Plan B program and the children's access 26 card program. These programs are funded by excess premium taxes imposed on 27 health insurance companies offering health insurance policies in the state of 28 Idaho. Excess premium taxes are deposited into a trust account pursuant to 29 section 41-406(d), Idaho Code, from which appropriations shall be made. In 30 order to protect the integrity of the program and to protect the children's 31 lives who will depend on the program, the director shall direct the CHIP Plan 32 B advisory board to establish an annual reserve. The advisory board shall con- 33 sider the number of enrollees and consider the level of benefits. The director 34 shall report the advisory board's findings to the joint finance-appropriations 35 committee and to the senate and house of representatives health and welfare 36 committees.

STATEMENT OF PURPOSE RS 14885C1 The purpose of this legislation is to direct the CHIP B Advisory Board to establish an annual reserve and to provide for reports to the joint finance-appropriations committee and the senate and house of representatives health and welfare committees.
