  2    RELATING TO PLUMBING AND PLUMBERS; AMENDING SECTION 54-2606,  IDAHO  CODE,  TO
  3        DELETE BONDING REQUIREMENTS FOR CERTIFICATION OF CONTRACTORS AND SPECIALTY
  4        CONTRACTORS AND TO PROVIDE LIABILITY INSURANCE REQUIREMENTS FOR CERTIFICA-
  5        TION  OF  CONTRACTORS  AND  SPECIALTY  CONTRACTORS;  AND  AMENDING SECTION
  6        54-2617, IDAHO CODE, TO REQUIRE THAT CONTRACTORS AND SPECIALTY CONTRACTORS
  7        HOLDING CERTIFICATES OF COMPETENCY SHALL COMPLY WITH THE LIABILITY  INSUR-
  8        ANCE REQUIREMENTS OF CERTIFICATION UPON RENEWAL OF A CERTIFICATE.
                                                                        
  9    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 10        SECTION  1.  That  Section 54-2606, Idaho Code, be, and the same is hereby
 11    amended to read as follows:
                                                                        
 12        54-2606.  POWERS AND DUTIES OF THE IDAHO PLUMBING  BOARD.  (1)  The  board
 13    shall have the general administration and supervision of the design, construc-
 14    tion,  installation,  improvement,  extension  and  alteration of plumbing and
 15    plumbing systems, except  that  which  has  been  heretofore  and  hereinafter
 16    exempted  from  the  jurisdiction of this board, in connection with all build-
 17    ings, residences and structures in this state including buildings,  residences
 18    and structures owned by the state or any political subdivision thereof.
 19        (2)  The  division  of building safety shall enforce the minimum standards
 20    and requirements therefor as provided by this chapter.
 21        (3)  The board may exercise such powers and duties as are reasonably  nec-
 22    essary  to  carry  out  the provisions of this chapter, and it may among other
 23    things:
 24        (a)  Establish the fees to be  charged  for  permits  and  inspections  of
 25        plumbing systems.
 26        (b)  Hold  public  meetings and attend or be represented at such meetings,
 27        within or without the state, prepare and publish rules pertaining to  this
 28        chapter,  and such other information as may be necessary, and furnish cop-
 29        ies thereof to those engaged in the business, trade, practice or  work  of
 30        plumbing and pipefitting and to the public upon request.
 31        (c)  Furnish  standards  and procedures and prescribe reasonable rules for
 32        examinations, qualification and certification of plumbing contractors  and
 33        journeymen  and  apprentice  plumbers not herein prescribed, including, on
 34        and after July 1, 2005, the furnishing, of a compliance bond in an  amount
 35        not to exceed two thousand dollars ($2,000) for the contractor classifica-
 36        tion,  or  evidence  of  such  coverage by a corporate industry group bond
 37        acceptable to the board proof of liability  insurance  in  the  amount  of
 38        three hundred thousand dollars ($300,000), and proof of worker's compensa-
 39        tion insurance, if applicable.
 40        (d)  Furnish  standards  and  procedures and prescribe reasonable rules to
 41        provide for the certification of specialty contractors, specialty journey-
 42        men, and specialty apprentices, including, on and after July 1, 2005,  the
 43        furnishing,  of  a compliance bond in an amount not to exceed two thousand

  1        dollars ($2,000) for the specialty contractor classification, or  evidence
  2        of  coverage  by  a  corporate industry group bond acceptable to the board
  3        proof of liability insurance in the amount of three hundred thousand  dol-
  4        lars ($300,000), and proof of worker's compensation insurance, if applica-
  5        ble.
  6        (e)  Establish  by  administrative  rule civil penalties not to exceed one
  7        thousand dollars ($1,000) for each count or separate offense, to  be  paid
  8        for  violations of this chapter and rules of the Idaho plumbing board; and
  9        to establish by administrative rule the process by which appeals from  the
 10        imposition  of  civil  penalties  may be heard. The board is authorized to
 11        affirm, reject, decrease or increase the  penalty  imposed;  however,  the
 12        board  shall  not  increase any penalty imposed to an amount exceeding one
 13        thousand dollars ($1,000) for each individual count or separate offense.
                                                                        
 14        SECTION 2.  That Section 54-2617, Idaho Code, be, and the same  is  hereby
 15    amended to read as follows:
                                                                        
 16        54-2617.  CERTIFICATE  EXPIRATION -- RENEWAL -- RULES FOR STAGGERED SCHED-
 17    ULE. (1) Certificates of competency shall be issued for a period of three  (3)
 18    years,  and shall expire three (3) years from the date of issue, unless sooner
 19    revoked or suspended.
 20        (2)  A certificate of competency may be renewed at  any  time  during  the
 21    month prior to its expiration. Failure of any holder to timely renew a certif-
 22    icate  of  competency  shall  cause  lapse  of  the certificate, but it may be
 23    revived within one (1) year without examination only upon payment of the  full
 24    initial fee.
 25        (3)  Persons  who hold a valid contractor or specialty contractor certifi-
 26    cate of competency on July 1, 2005, shall comply with the  insurance  require-
 27    ments of section 54-2606, Idaho Code, upon renewal of the certificate.
 28        (4)  The  board shall promulgate rules to provide for a staggered schedule
 29    of issuing and renewing certificates of competency.

  2        On page 1 of the printed bill, in line 34, delete ", of a compliance  bond
  3    in an amount" and insert: "of a compliance license bond in an amount"; in line
  4    35,  delete  "not to exceed two thousand dollars ($2,000)" and insert: "not to
  5    exceed two thousand dollars ($2,000)";  in  line  39,  following  "applicable"
  6    insert:  ";  provided however, that where a bond has been provided as required
  7    by this section prior to July 1, 2005, a license bond shall only  be  required
  8    upon  the  expiration  of  such  existing  bond";  delete  line 43 and insert:
  9    "furnishing of a compliance license bond in an amount not to exceed two  thou-
 10    sand";  on  page  2, in line 1, delete "dollars ($2,000)" and insert: "dollars
 11    ($2,000)"; and in line 5, following "ble" insert: ";  provided  however,  that
 12    where  a  bond  has been provided as required by this section prior to July 1,
 13    2005, a license bond shall only be required upon the expiration of such exist-
 14    ing bond".
                                                                        
 15                                 CORRECTION TO TITLE
 16        On page 1, in line 3, delete "DELETE" and insert: "REVISE".

                      STATEMENT OF PURPOSE

This legislation replaces the requirement for Plumbing
contractors and specialty contractors to provide a $2,000.00
bond. In lieu of bonding, Plumbing contractors and specialty
contractors will provide proof of liability insurance in the
amount of $300,000.00 and proof of worker's compensation
insurance if required.
