2 RELATING TO MOTOR VEHICLES; AMENDING SECTION 49-1305, IDAHO CODE, TO INCREASE
3 THE AMOUNT OF PROPERTY DAMAGE REQUIRED TO INITIATE A REPORT TO THE LOCAL
4 POLICE DEPARTMENT.
5 Be It Enacted by the Legislature of the State of Idaho:
6 SECTION 1. That Section 49-1305, Idaho Code, be, and the same is hereby
7 amended to read as follows:
8 49-1305. IMMEDIATE NOTICE OF ACCIDENTS. (1) The driver of a vehicle
9 involved in an accident resulting in injury to or death of any person, or dam-
10 age to the property of any one (1) person in excess of seven hundred and fifty
11 two thousand dollars ($752,000) shall immediately, by the quickest means of
12 communication, give notice of the accident to the local police department if
13 the accident occurs within a city, otherwise to the office of the county sher-
14 iff or the nearest office of the state police.
15 (2) Whenever the driver of a vehicle is physically incapable of giving
16 immediate notice of an accident as required herein, and there was another
17 occupant in the vehicle at the time of the accident capable of doing so, the
18 occupant shall give or cause to be given the notice not given by the driver.

2 On page 1 of the printed bill, in line 10, delete "seven hundred and
3 fifty" and insert: "seven one thousand five hundred and fifty"; and in line
4 11, delete "two thousand dollars ($752,000)" and insert: "dollars ($751,500)".
5 AMENDMENT TO THE BILL
6 On page 1, following line 18, insert:
7 "SECTION 2. This act shall be in full force and effect on and after Janu-
8 ary 1, 2006.".
9 CORRECTION TO TITLE
10 On page 1, in line 4, following "DEPARTMENT" insert: "; AND PROVIDING AN
11 EFFECTIVE DATE".

5 Be It Enacted by the Legislature of the State of Idaho:

STATEMENT OF PURPOSE

This legislation amends section 49-1305, Idaho Code, to reflect a
change which will allow the investigation of a property damage
only motor vehicle crash to be reported only if at least
$2,000.00 in damage occurs. It is estimated this will reduce
many police officer's accident investigation time by 40% to 50%
on all property damage only accidents. This will allow law
enforcement officers considerably more time to perform other more
important duties to protect the citizens of this state.
FISCAL NOTE
There will be no fiscal impact on the general fund.
