  1                                        AN ACT
  2    RELATING TO VETERANS; AMENDING SECTION 65-505, IDAHO CODE, TO  STRIKE  CERTAIN
  3        LIMITATIONS  ON DAMAGES, COSTS OF SUIT AND ATTORNEY'S FEES RELATING TO THE
  4        VIOLATIONS INVOLVING THE PREFERENCE TO BE GIVEN VETERANS BY PUBLIC EMPLOY-
  5        ERS AND TO MAKE TECHNICAL CORRECTIONS.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION 1.  That Section 65-505, Idaho Code, be, and the  same  is  hereby
  8    amended to read as follows:
                                                                        
  9        65-505.  FAILING  OR  REFUSING  TO GIVE PREFERENCE -- CIVIL LIABILITY. All
 10    elective officers, department heads, boards, commissions and all other  public
 11    officials  in any state, county and municipal governments and departments, and
 12    in all political subdivisions thereof, who deliberately or wilfully  willfully
 13    refuse  or  fail  to give preference to qualified war veterans required by the
 14    provisions of this act chapter shall be subject to writs of  mandate  pursuant
 15    to  sections  7-301 to through 7-314, Idaho Code, and if found in violation of
 16    any such provisions shall be required to pay the costs of suit and  reasonable
 17    attorney's  fees  incurred  in  such  action, and shall further be required to
 18    employ or reemploy the war veteran, and shall be required to  pay  as  damages
 19    such  amount  as the court may award, but in no event shall the amount of such
 20    damages, costs of suit and attorney's fees exceed the sum of two hundred fifty
 21    dollars ($250).

                       STATEMENT OF PURPOSE

                            RS 14862C1

The purpose of this legislation is to update Idaho Code, 65-
505 which deals with veterans preference.

Changes to Idaho Code 65-505 include technical changes and
striking of the limitations awarded for violations.  The amount
awarded for violations has not been updated for a number of
years. 



                           FISCAL NOTE

There is no fiscal impact to the general fund.
