Division of Veterans Services Fund; to delete the Veterans Home Fund as
part of distribution of moneys from the Charitable Institutions Fund; and

  1                                        AN ACT
  2    RELATING TO THE DIVISION OF VETERANS SERVICES; AMENDING SECTION 66-1106, IDAHO
  3        CODE, TO PROVIDE FOR THE DIVISION OF VETERANS SERVICES FUND AND TO  DELETE
  4        THE VETERANS HOME FUND AS PART OF DISTRIBUTION OF MONEYS FROM THE CHARITA-
  5        BLE  INSTITUTIONS  FUND; AND AMENDING SECTION 66-1107, IDAHO CODE, TO PRO-
  6        VIDE THAT THE DIVISION OF VETERANS SERVICES RATHER THAN  THE  IDAHO  STATE
  7        VETERANS  HOMES SHALL BE A BENEFICIARY OF THE CHARITABLE INSTITUTIONS LAND
  8        GRANT AND TO MAKE A TECHNICAL CORRECTION.
                                                                        
  9    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 10        SECTION 1.  That Section 66-1106, Idaho Code, be, and the same  is  hereby
 11    amended to read as follows:
                                                                        
 12        66-1106.  CHARITABLE  INSTITUTIONS  FUND -- TRANSFER OF MONEYS TO SEPARATE
 13    FUNDS. Any and all moneys hereafter accruing to said  charitable  institutions
 14    fund  shall  be forthwith transferred and credited to the following designated
 15    funds in the following proportions, respectively, to wit:
 16        To the Idaho State University fund, four-fifteenths (4/15) thereof;
 17        To the  State  Juvenile  Corrections  Institutions  fund,  four-fifteenths
 18    (4/15) thereof;
 19        To the State Hospital North fund, four-fifteenths (4/15) thereof;
 20        To  the  Division  of  Veterans Home Services fund, five-thirtieths (5/30)
 21    thereof;
 22        To the School for the Deaf and Blind fund, one-thirtieth (1/30) thereof.
                                                                        
 23        SECTION 2.  That Section 66-1107, Idaho Code, be, and the same  is  hereby
 24    amended to read as follows:
                                                                        
 25        66-1107.  MONEYS  CREDITED  OR ACCRUING TO SPECIAL FUNDS -- EXCLUSIVE USE.
 26    All moneys heretofore properly credited to or accruing  to  any  special  fund
 27    heretofore  created  out of any portion of the expendable income from the land
 28    grant of one hundred and fifty thousand (150,000)  acres  aforesaid,  for  the
 29    support  or maintenance of the Idaho State University, the State Juvenile Cor-
 30    rections Center, State Hospital North, Idaho State Veterans Homes Division  of
 31    Veterans  Services  and  the  State School for the Deaf and the Blind, respec-
 32    tively, or any of such institutions, together with all funds hereafter  accru-
 33    ing under this act to the funds designated in section 66-1106, Idaho Code, are
 34    hereby  appropriated  for  the maintenance of said institutions, respectively,
 35    and no portion of said funds shall be diverted to any other purpose or  trans-
 36    ferred  to any other fund: provided, that no provision hereof shall be so con-
 37    strued as to preclude the state  controller  from  correcting  errors  in  the
 38    apportionment of receipts or distribution of disbursements heretofore or here-
 39    after erroneously credited or charged to any of such funds.

This legislation allows the Division of Veterans Services
flexibility to use Endowment Funds division-wide for programs
such as the Emergency Grant and State Veteran Cemetery programs
