1 AN ACT
2 RELATING TO COCKFIGHTING; REPEALING SECTION 25-3506, IDAHO CODE, RELATING TO
3 THE EXHIBITION OF COCKFIGHTS; AND AMENDING CHAPTER 35, TITLE 25, IDAHO
4 CODE, BY THE ADDITION OF A NEW SECTION 25-3506, IDAHO CODE, TO PROHIBIT
5 CERTAIN ACTS RELATING TO COCKFIGHTING AND TO PROVIDE PUNISHMENT.
6 Be It Enacted by the Legislature of the State of Idaho:
7 SECTION 1. That Section 25-3506, Idaho Code, be, and the same is hereby
8 repealed.
9 SECTION 2. That Chapter 35, Title 25, Idaho Code, be, and the same is
10 hereby amended by the addition thereto of a NEW SECTION, to be known and des-
11 ignated as Section 25-3506, Idaho Code, and to read as follows:
12 25-3506. COCKFIGHTING. (1) A person commits the crime of cockfighting if
13 the person knowingly does any of the following:
14 (a) Owns, possesses, keeps, breeds, trains, buys, sells or offers to sell
15 a bird for fighting exhibitions;
16 (b) Promotes, conducts or performs any service in the furtherance of, an
17 exhibition of cockfighting, organizing a cockfight, advertising a
18 cockfight, or providing or serving as a stakes holder for any money
19 wagered on a cockfight;
20 (c) Keeps, uses or manages any place kept or used for the purpose of
21 cockfighting; or
22 (d) Permits any place over which the person has possession or control to
23 be occupied, kept or used for the purpose of an exhibition of
24 cockfighting.
25 (2) Any person found guilty of a violation of this section shall, upon
26 conviction, be guilty of a felony and be punished by incarceration not exceed-
27 ing two (2) years or a fine of not more than fifteen thousand dollars
28 ($15,000), or by both such fine and imprisonment.

This legislation amends Chapter 35, Title 25, Idaho Code, defines
cock fighting, provides punishment, and makes cock fighting a
felony.
