]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-eighth Legislature First Regular Session - 2005IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 233 BY EDUCATION COMMITTEE 1 AN ACT 2 RELATING TO DOGFIGHTING; AMENDING SECTION 25-3507, IDAHO CODE, TO REVISE 3 DESCRIPTIVE LANGUAGE, TO PROHIBIT CERTAIN ACTS RELATING TO DOGFIGHTING AND 4 TO PROVIDE PUNISHMENT. 5 Be It Enacted by the Legislature of the State of Idaho: 6 SECTION 1. That Section 25-3507, Idaho Code, be, and the same is hereby 7 amended to read as follows: 8 25-3507.EXHIBITION OF DOGFIGHTSDOGFIGHTING.Every(1) A personwho par-9ticipates in a public or private display of combat between two (2) or more10dogs in which the fighting, killing, maiming or injuring of dogs is a signifi-11cant feature is guilty of a misdemeanor andshall, upon conviction, be pun-12ished in accordance with section 25-3520A, Idaho Codecommits the crime of 13 dogfighting if the person knowingly does any of the following: 14 (a) Owns, possesses, keeps, breeds, trains, buys, sells or offers to sell 15 a dog for fighting exhibitions; 16 (b) Promotes, conducts or performs any service in the furtherance of, an 17 exhibition of dogfighting, advertising a dogfight, or providing or serving 18 as a stakes holder for any money wagered on a dogfight; 19 (c) Keeps, uses or manages any place kept or used for the purpose of 20 dogfighting; 21 (d) Permits any place over which the person has possession or control to 22 be occupied, kept or used for the purpose of an exhibition of dogfighting; 23 or 24 (e) Takes, leads away, possesses, confines, sells, transfers, receives, 25 with the intent to deprive the owner of, any pet animal for the intent of 26 dog fighting, training, breeding or baiting. 27 (2) Any person found guilty of a violation of this section shall, upon 28 conviction, be guilty of a felony and punished by incarceration not exceeding 29 two (2) years or a fine of not more than fifteen thousand dollars ($15,000), 30 or by both such fine and imprisonment. 31 (3) Nothing in this section prohibits demonstrations of the hunting, 32 herding, working or tracking skills of dogs or the lawful use of dogs for 33 hunting, herding, working, tracking or self and property protection.
STATEMENT OF PURPOSE RS 15017 The purpose of this legislation is to amend Section 25-3507, Idaho Code, to make dog fighting a felony, to define dog fighting, and to provide punishment.
