  1                                        AN ACT
  2    RELATING TO THE STATE MEDICAL ASSISTANCE PROGRAM;  AMENDING  SECTION  56-209d,
  3        IDAHO  CODE, TO PROVIDE THAT THE COST OF PHYSICIAN, HOSPITAL OR OTHER SER-
  4        VICES DEEMED EXPERIMENTAL ARE EXCLUDED FROM COVERAGE AND TO  PROVIDE  THAT
  5        THE DIRECTOR OF THE DEPARTMENT OF HEALTH AND WELFARE MAY ALLOW COVERAGE OF
  6        PROCEDURES  OR  SERVICES  DEEMED INVESTIGATIONAL IF THE PROCEDURES OR SER-
  7        VICES ARE AS COST EFFECTIVE AS TRADITIONAL, STANDARD TREATMENTS; AND  PRO-
  8        VIDING AN EFFECTIVE DATE.
                                                                        
  9    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 10        SECTION  1.  That  Section 56-209d, Idaho Code, be, and the same is hereby
 11    amended to read as follows:
                                                                        
 12        56-209d.  MEDICAL ASSISTANCE PROGRAM -- SERVICES TO BE PROVIDED -- EXPERI-
 13    MENTAL SERVICES OR PROCEDURES EXCLUDED. Notwithstanding any other provision of
 14    this chapter, medical assistance shall increase:
 15        (1)  Payment as determined under rules established by  the  director  from
 16    forty  (40)  days per fiscal year to unlimited days of inpatient hospital care
 17    per state fiscal year.
 18        (2)  Payment as determined under rules established by  the  director  from
 19    thirty  dollars  ($30.00) per month to an unlimited amount of prescribed drugs
 20    for each recipient.
 21        (3)  Provision of eligibility for  medical  assistance  for  residents  of
 22    skilled  and  intermediate  care  facilities who meet the medical criteria for
 23    medical assistance, from those with countable income of two  hundred  one  and
 24    two-tenths  percent  (201.2%)  to those with countable income of three hundred
 25    percent (300%) of the SSI standard.
 26        (4)  Payment, as authorized by title XIX of the social  security  act,  as
 27    amended, and as determined under rules established by the director for:
 28        (a)  Durable medical equipment.
 29        (b)  Soft organ transplants.
 30        (c)  Adult dental services.
 31        (d)  Adult vision services.
 32        (e)  Adult hearing services.
 33        (f)  Prosthetics.
 34        (g)  Assistive and augmentative communication devices.
 35        (5)  Payment for breast and cervical cancer-related treatment services for
 36    persons  who  are  eligible  for screening for these cancers under the federal
 37    centers for disease control and prevention's national breast and cervical can-
 38    cer early detection program, and are eligible for medical assistance  pursuant
 39    to  the  provisions  of the federal "Breast and Cervical Cancer Prevention and
 40    Treatment Act of 2000" (Pub. L. 106-354).
 41        (6)  The cost of physician, hospital or other services deemed experimental
 42    are excluded from coverage. The director may allow coverage of  procedures  or
 43    services  deemed  investigational  if  the  procedures or services are as cost

  1    effective as traditional, standard treatments.
                                                                        
  2        SECTION 2.  This act shall be in full force and effect on and  after  July
  3    1, 2006.

The purpose of this legislation is to specify services and
treatments not covered under Idaho's state medical assistance
program.



                           FISCAL NOTE

The fiscal impact to the general fund is positive to the extent
that certain services are not covered.
