  1                                        AN ACT
  2    APPROPRIATING MONEYS TO THE ATTORNEY GENERAL FOR FISCAL  YEAR  2006;  LIMITING
  3        THE  NUMBER  OF AUTHORIZED FULL-TIME EQUIVALENT POSITIONS; REAPPROPRIATING
  4        UNEXPENDED AND UNENCUMBERED BALANCES OF  THE  GENERAL  FUND;  AND  SETTING
  5        FORTH THE CONDITIONS FOR THE REAPPROPRIATION.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION  1.  There is hereby appropriated to the Attorney General the fol-
  8    lowing amounts to be expended for the designated  programs  according  to  the
  9    designated  expense classes from the listed funds for the period July 1, 2005,
 10    through June 30, 2006:

 25        SECTION 2.  In accordance with Section 67-3519, Idaho Code,  the  Attorney
 26    General  is  authorized  no  more  than one hundred eighty and sixty-five hun-
 27    dredths (180.65) full-time equivalent positions at any point during the period
 28    July 1, 2005, through June 30, 2006, for the programs specified in  Section  1
 29    of  this  act,  unless  specifically  authorized  by  the  Governor. The Joint
 30    Finance-Appropriations Committee will be notified promptly  of  any  increased
 31    positions so authorized.
                                                                        
 32        SECTION  3.  There  is hereby reappropriated to the Office of the Attorney
 33    General for Special Litigation, subject to the provisions of Section 4 of this
 34    act, the unexpended and unencumbered balance of General Fund moneys as  appro-
 35    priated  for Special Litigation for fiscal years 2004 and 2005, to be used for
 36    nonrecurring expenditures, for the period July 1, 2005, through June 30, 2006.
                                                                        
 37        SECTION 4.  The reappropriation for the General Fund granted in Section  3
 38    of this act shall be subject to the following provisions:
 39        (1)  If  the  unexpended  and  unencumbered balance in the General Fund on
 40    June 30, 2005, is zero, the reappropriation for the General Fund in Section  3

  1    of this act is hereby declared to be null and void.
  2        (2)  If  the  unexpended  and  unencumbered balance in the General Fund on
  3    June 30, 2005, is greater than zero, but less than the total General Fund  re-
  4    appropriation authority granted to all state agencies, that amount reappropri-
  5    ated in Section 3 of this act shall be in the proportion that the reappropria-
  6    tion of the Office of the Attorney General bears to the total General Fund re-
  7    appropriation authority granted to all state agencies.
