  1                                        AN ACT
  2    RELATING TO COUNTY-BASED INTERMODAL  COMMERCE  AUTHORITIES;  AMENDING  SECTION
  3        70-2203,  IDAHO CODE, TO PROVIDE FOR THE CREATION OF AN INDEPENDENT PUBLIC
  4        BODY TO BE KNOWN AS THE LOCAL COUNTY-BASED INTERMODAL COMMERCE  AUTHORITY;
  5        AND DECLARING AN EMERGENCY.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION  1.  That  Section 70-2203, Idaho Code, be, and the same is hereby
  8    amended to read as follows:
                                                                        
  9        70-2203.  ESTABLISHMENT AND ABOLISHMENT. Any county, hereinafter  referred
 10    to  as  a  governing body, may, after a public hearing, by resolution or ordi-
 11    nance of its governing body, create an independent public body, corporate  and
 12    politic,  to  be  known as a local county-based intermodal commerce authority.
 13    Any county after establishment of an intermodal authority may, after a  public
 14    hearing,  by  resolution or ordinance abolish the county-based intermodal com-
 15    merce authority. A county-based intermodal commerce authority shall be  autho-
 16    rized  to exercise its functions upon the appointment and qualification of the
 17    first commissioners thereof. The resolution or ordinance creating an authority
 18    shall include provisions for governance and how the  authority  shall  conduct
 19    its  affairs.  The  board of directors shall consist of no less than three (3)
 20    members.
                                                                        
 21        SECTION 2.  An emergency existing  therefor,  which  emergency  is  hereby
 22    declared to exist, this act shall be in full force and effect on and after its
 23    passage and approval.

The purpose of this bill is to designate that intermodal commerce
authorities are an independent public body subject to provisions
of counties that create them for commerce and economic
development.
