  1                                        AN ACT
  2    APPROPRIATING ADDITIONAL MONEYS TO THE SUPREME COURT FOR DRUG  COURTS,  FAMILY
  3        COURT SERVICES, AND MENTAL HEALTH COURTS FOR FISCAL YEAR 2006; APPROPRIAT-
  4        ING  ADDITIONAL  MONEYS TO THE DEPARTMENT OF HEALTH AND WELFARE FOR COMMU-
  5        NITY MENTAL HEALTH SERVICES FOR FISCAL YEAR 2006;  EXPRESSING  LEGISLATIVE
  6        INTENT  WITH  REGARD TO AN INTERBRANCH AGREEMENT BETWEEN THE IDAHO SUPREME
  7        COURT AND THE DEPARTMENT  OF  HEALTH  AND  WELFARE;  AND  AUTHORIZING  THE
  8        DEPARTMENT OF HEALTH AND WELFARE TO MAXIMIZE FEDERAL FUND PARTICIPATION IN
  9        THE TREATMENT OF ELIGIBLE PERSONS THROUGH THE MENTAL HEALTH COURTS.
                                                                        
 10    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 11        SECTION  1.  In addition to any other appropriation provided by law, there
 12    is hereby appropriated $1,200,000 from the Court Services Fund to the  Supreme
 13    Court  for drug courts, family court services and mental health courts for the
 14    period July 1, 2005, through June 30, 2006.
                                                                        
 15        SECTION 2.  In addition to any other appropriation provided by law,  there
 16    is  hereby  appropriated to the Department of Health and Welfare for Community
 17    Mental Health Services the following amounts to be expended according  to  the
 18    designated  expense classes from the listed funds for the period July 1, 2005,
 19    through June 30, 2006:

 28        SECTION 3.  It is hereby declared to be the intent of the Legislature that
 29    the Department of Health and Welfare negotiate and enter into  an  interbranch
 30    agreement with the Idaho Supreme Court concerning the development of treatment
 31    options  for  mental  health court participants as funded in Section 2 of this
 32    act. Issues that should be covered in the agreement include a  description  of
 33    treatment  services,  notification  and discharge communication, treatment and
 34    referral criteria, confidentiality issues, frequency and type of  client  con-
 35    tact,  assessment  criteria,  provisions for periodic review and modification,
 36    and other relevant information as determined by the parties. The Department of
 37    Health and Welfare shall continue, through its membership on  the  Drug  Court
 38    and  Mental  Health  Court  Coordinating  Committee,  as authorized by Section
 39    19-5606, Idaho Code, to participate and  provide  guidance  in  the  decision-
 40    making  and  the  formulation  of  recommendations to the Supreme Court on the
 41    statewide implementation of mental health courts.

  1        SECTION 4.  The Department of Health and Welfare is authorized  to  recog-
  2    nize  the  state  funds provided for in this act as part of the statewide cost
  3    allocation process, in order to maximize federal  fund  participation  in  the
  4    treatment of eligible persons through the mental health courts.

Fiscal Note

Provides an additional appropriation of $1,200,000 from the Court Services Fund to the Supreme Court to expand drug courts, mental health courts, and family court services for fiscal year 2006. It also provides an additional appropriation of $337,100 to the Department of Health and Welfare for Community Mental Health Services for fiscal year 2006. Of this amount for the Department of Health and Welfare, $266,700 is from the Court Services Fund and $70,400 is from the Cooperative Welfare Fund (Federal).
