SENATE BILL NO. 1056

1 AN ACT
2 RELATING TO THE IDAHO BEEF COUNCIL; AMENDING SECTION 25-2907, IDAHO CODE, TO
3 INCREASE CERTAIN ASSESSMENTS UNDER TERMS SPECIFIED AND TO PROVIDE FOR
4 REFUNDS UNDER TERMS SPECIFIED; AND DECLARING AN EMERGENCY.
5 Be It Enacted by the Legislature of the State of Idaho:
6 SECTION 1. That Section 25-2907, Idaho Code, be, and the same is hereby
7 amended to read as follows:
8 25-2907. ASSESSMENTS -- COLLECTION. (1) There is hereby levied and
9 imposed upon all cattle an assessment of not more than fifty cents (50¢) per
10 head, to be paid by the owner.
11 (2) The assessment imposed by this section shall be collected:
12 (a) Each time a change in ownership of cattle occurs.
13 (b) When Idaho cattle leave the state permanently even though no change
14 in ownership occurs.
15 (3) The state brand inspector shall collect state or other beef promotion
16 assessments in addition to, at the same time and in the same manner as the fee
17 charged for the state brand inspection. Such assessment so collected belongs
18 to and shall be paid to the Idaho beef council, either directly or later by
19 remittance together with a report. The council shall reimburse the state brand
20 inspector for the reasonable and necessary expenses incurred for such collec-
21 tion, in an amount determined by the council and the inspector.
22 (4) In the event the federal beef promotion and research act is no longer
23 in effect:
24 (a) The Idaho beef council shall have the authority to increase the
25 assessment provided for in subsection (1) of this section to not more than
26 one dollar ($1.00) per head.
27 (b) Any person may submit a written request for a refund of a collected
28 assessment, or any portion thereof, to the council within thirty (30) cal-
29 endar days after payment of the assessment. The council shall make the
30 refund no later than sixty (60) calendar days after receipt of the refund
31 request, provided the council has received the assessment from the state
32 brand inspector.
33 SECTION 2. An emergency existing therefor, which emergency is hereby
34 declared to exist, this act shall be in full force and effect on and after its
35 passage and approval.
STATEMENT OF PURPOSE

The purpose of this proposed legislation is to provide for the
Idaho Beef Council to have the authority to raise the beef
promotion state assessment on cattle from not more than fifty
cents ($.50) per head to not more than one dollar ($1.00) per
head. The authority to raise this assessment would be authorized
only if the federal beef promotion and research act is no longer
in effect. Should this increase take place, a refund for the
collected assessment, or any portion thereof, would be allowed.
The legislation contains an emergency clause in case the federal
beef promotion and research act is no longer in effect prior to
July 1, 2005.
