2 RELATING TO MOTOR VEHICLES; AMENDING SECTION 49-808, IDAHO CODE, TO SET FORTH
3 SAFETY PROVISIONS FOR PERSONS TURNING A VEHICLE ONTO A HIGHWAY, MOVING A
4 VEHICLE RIGHT OR LEFT UPON A HIGHWAY OR MERGING ONTO OR EXITING FROM A
5 HIGHWAY.
6 Be It Enacted by the Legislature of the State of Idaho:
7 SECTION 1. That Section 49-808, Idaho Code, be, and the same is hereby
8 amended to read as follows:
9 49-808. TURNING MOVEMENTS AND REQUIRED SIGNALS. (1) No person shall turn
10 a vehicle onto a highway or move a vehicle right or left upon a highway or
11 merge onto or exit from a highway unless and until the movement can be made
12 with reasonable safety nor without giving an appropriate signal.
13 (2) A signal of intention to turn or move right or left when required
14 shall be given continuously to warn other traffic. On controlled-access high-
15 ways and before turning from a parked position, the signal shall be given con-
16 tinuously for not less than five (5) seconds and, in all other instances, for
17 not less than the last one hundred (100) feet traveled by the vehicle before
18 turning.
19 (3) No person shall stop or suddenly decrease the speed of a vehicle
20 without first giving an appropriate signal to the driver of any vehicle imme-
21 diately to the rear when there is opportunity to give such a signal.
22 (4) The signals required on vehicles by section 49-809, Idaho Code, shall
23 not be flashed on one (1) side only on a disabled vehicle, flashed as a cour-
24 tesy or "do pass" signal to operators of other vehicles approaching from the
25 rear, nor be flashed on one (1) side only of a parked vehicle except as may be
26 necessary for compliance with this section.
STATEMENT OF PURPOSE
RS 14548
This proposed legislation will amend Section 49-808 to clarify
when motorists are required to signal. The statute requires
motorists to signal when merging onto a highway or when leaving a
highway.
FISCAL NOTE
The fiscal impact is neutral. This amendment simply clarifies
the statute as the Legislature intended it to be interpreted in
the first place.
