  1                                        AN ACT
  2    RELATING TO SIMULCASTING OF DOG RACES; AMENDING SECTION 54-2514A, IDAHO  CODE,
  3        TO  AUTHORIZE SIMULCASTS AND PARI-MUTUEL WAGERING AT AN ALTERNATE FACILITY
  4        IN THE SAME COUNTY AS A FORMER DOG RACING TRACK IF APPROVED BY  THE  IDAHO
  5        RACING COMMISSION.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION  1.  That Section 54-2514A, Idaho Code, be, and the same is hereby
  8    amended to read as follows:
                                                                        
  9        54-2514A.  DOG RACING ILLEGAL AFTER THE EFFECTIVE DATE OF THIS ACT. On and
 10    after the effective date of this act, live dog races and  pari-mutuel  betting
 11    on  such  races  or the training of dogs to compete in live dog races shall be
 12    illegal in the state of Idaho. The provisions of this  section  shall  not  be
 13    deemed  to  alter or affect simulcasts and simulcast pari-mutuel wagering at a
 14    facility that was licensed  and authorized prior to January 1, 1996,  to  con-
 15    duct  live  dog  races and pari-mutuel wagering on them prior to the effective
 16    date of this act,  and  such  simulcasts  and  pari-mutuel  wagering  on  such
 17    simulcasts  may  be conducted at that facility, or at an alternate facility in
 18    the same county and approved by the commission as if the facility  were  still
 19    licensed  and  under  the same conditions and restrictions imposed by law on a
 20    licensee.  Any  person  participating  or  conducting  a  live  dog  race   or
 21    pari-mutuel betting on such a live dog race or the training of dogs to compete
 22    in live dog races in violation of this section shall be guilty of a felony.

  1                               AMENDMENTS TO SECTION 1
  2        On page 1 of the printed bill, delete line 12 and insert: "illegal in  the
  3    state  of  Idaho.  Notwithstanding any other provision of law to the contrary,
  4    tThe provisions of this section shall not be"; and in line 16,  following  the
  5    first  "and"  delete "such" and insert: "such horse and dog race"; and in line
  6    20, following "licensee." insert: "Under no circumstances shall the provisions
  7    of this section or section 54-2512, Idaho Code, be used to grant more than one
  8    (1) license to conduct simulcast pari-mutuel wagering in any county.".
                                                                        
  9                                 CORRECTION TO TITLE
 10        On page 1, in line 5, following "COMMISSION" insert: "AND TO CLARIFY  THAT
 11    NO  MORE  THAN  ONE  LICENSE  CAN  BE GRANTED TO CONDUCT SIMULCAST PARI-MUTUEL
 12    WAGERING IN ANY COUNTY".

  7    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  8        SECTION 1.  That Section 54-2514A, Idaho Code, be, and the same is  hereby
  9    amended to read as follows:
                                                                        
 10        54-2514A.  DOG RACING ILLEGAL AFTER THE EFFECTIVE DATE OF THIS ACT. On and
 11    after  the  effective date of this act, live dog races and pari-mutuel betting
 12    on such races or the training of dogs to compete in live dog  races  shall  be

 18    such horse and dog race simulcasts and pari-mutuel wagering on such simulcasts
 19    may be conducted at that facility, or at an alternate  facility  in  the  same

 21    and under the same conditions and restrictions imposed by law on  a  licensee.
 22    Under  no  circumstances  shall  the  provisions  of  this  section or section
 23    54-2512, Idaho Code, be used to grant more than one  (1)  license  to  conduct
 24    simulcast pari-mutuel wagering in any county. Any person participating or con-
 25    ducting  a live dog race or pari-mutuel betting on such a live dog race or the
 26    training of dogs to compete in live dog races in  violation  of  this  section
 27    shall be guilty of a felony.

Statement of Purpose / Fiscal Impact


                       STATEMENT OF PURPOSE

The purpose of this act is to prevent the loss of monies paid annually to
the public school income fund, Idaho Fair Circuit, Kootenai County,
horse owners and breeders and the State Racing Commission by the
Greyhond Park and Events Center at Post Falls in the event that property
is converted to other uses by the present or subsequent owners.
      
      
                           FISCAL IMPACT
                                 
Passage of this act creates no negative fiscal impact on either state or
local government. However without these amendments to 54-2514A if
simulcast wagering operations are ceased because of a change in
ownership or use of the present facility, average annual payments to the
Idaho Racing Commission of $161,081, Horse Breed Account $44,200,
Small Track Fund $43,944, Public School Income Fund $12,464, the
Equine Account $17,795, Horse Owners & Breeders $$6,l08, Kootenai
County $12,215 and purse payments to HBPA of $277,753 would be
discontinued representing an average, annual total loss of $575,560.
