]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-eighth Legislature First Regular Session - 2005IN THE SENATE SENATE BILL NO. 1080 BY TRANSPORTATION COMMITTEE 1 AN ACT 2 RELATING TO THE PLATE MANUFACTURING ACCOUNT; AMENDING SECTION 49-450, IDAHO 3 CODE, TO PROVIDE THAT THE ACTUAL COST OF PRODUCING AND DISTRIBUTING 4 LICENSE PLATES SHALL BE PAID FROM THE PLATE MANUFACTURING ACCOUNT AND TO 5 PROVIDE FOR DISTRIBUTIONS TO THE HIGHWAY DISTRIBUTIONS ACCOUNT; AMENDING 6 SECTION 49-450A, IDAHO CODE, TO EXPAND THE PURPOSE OF THE PLATE MANUFAC- 7 TURING ACCOUNT TO INCLUDE PAYING THE ACTUAL COST OF PRODUCING AND DISTRIB- 8 UTING LICENSE PLATES AND TO AUTHORIZE THE STATE CONTROLLER TO DISTRIBUTE 9 ADDITIONAL FUNDS TO PAY PRODUCTION AND DISTRIBUTION COSTS; AND DECLARING 10 AN EMERGENCY. 11 Be It Enacted by the Legislature of the State of Idaho: 12 SECTION 1. That Section 49-450, Idaho Code, be, and the same is hereby 13 amended to read as follows: 14 49-450. ADDITIONAL FEE FOR EACH PLATE ISSUED. In addition to the vehicle 15 registration fee provided by law, whenever any plate is issued for vehicle 16 registration, there shall be charged a fee of three dollars ($3.00) per plate, 17 which shall be deposited into the plate manufacturing account created in sec- 18 tion 49-450A, Idaho Code. The actual cost of producing andmanufacturingdis- 19 tributing license plates and the fifty cents ($.50) per plate fee designated 20 to the Idaho heritage trust for the use of the copyrighted design provided for 21 in section 49-443(1), Idaho Code, shall be paid from the plate manufacturing 22 account. Theremainder of the plate fee shall be deposited indifference 23 between deposits into the account and disbursements out of the account not 24 required for future obligations shall be transferred by the state controller 25 from the plate manufacturing account to the highway distribution account as 26 established in section 40-701, Idaho Code, for apportionment as designated in 27 that section. Funds designated to the Idaho heritage trust shall be matched 28 with equal funds from other sources for funding projects designed to preserve 29 Idaho's historic resources. 30 SECTION 2. That Section 49-450A, Idaho Code, be, and the same is hereby 31 amended to read as follows: 32 49-450A. PLATE MANUFACTURING ACCOUNT. There is hereby created in the 33 state treasury an account to be known as the "plate manufacturing account" for 34 the purpose of paying the actual cost tomanufactureproduce and distribute 35 license plates and to pay costs related to use of the centennial design on the 36 license plate. All moneys in this account are hereby continuously appropriated 37 to the department. Any additional funds required to pay platemanufacturing38 production and distribution costs will be transferred by the state controller 39 from the state highway account. 40 SECTION 3. An emergency existing therefor, which emergency is hereby 2 1 declared to exist, this act shall be in full force and effect on and after its 2 passage and approval.
STATEMENT OF PURPOSE RS 14398C1 This legislation will amend Sections 49-450 and 49-450A, Idaho Code, to allow all costs associated with the production and distribution of license plates (including postage costs currently paid by the consumer) to be paid from the Plate Manufacturing Account. By Idaho Code, ITD is required to implement a license plate reservation program every seven years. This legislation will allow the actual postage and packaging costs associated with the reservation program to be deposited in the plate manufacturing account, which is continuously appropriated. This action will alleviate the need for ITD to ask for additional spending authority to cover the actual costs paid to Correctional Industries for the packaging and distribution of plates under the plate reservation program. Program accounting will be significantly improved by consolidating all financial activity in a single fund which is continuously appropriated. FISCAL IMPACT This legislation will allow ITD to reduce its base budget by approximately $41,700 which is currently used to pay the cost of mailing specialty plates. If this legislation does not pass, ITD would need to request an enhancement to increase the base budget to pay the additional postage costs from the standard operating budget.
