13 MOUS AWARD OF THE IDAHO LAW ENFORCEMENT, FIREFIGHTING AND EMS MEDAL OF
14 HONOR; AMENDING SECTION 67-8805, IDAHO CODE, TO PROVIDE FOR THE DESIGN AND
15 COST OF THE IDAHO LAW ENFORCEMENT, FIREFIGHTING AND EMS MEDAL OF HONOR;
16 AND AMENDING CHAPTER 88, TITLE 67, IDAHO CODE, BY THE ADDITION OF A NEW
17 SECTION 67-8806, IDAHO CODE, TO DEFINE TERMS.
18 Be It Enacted by the Legislature of the State of Idaho:
19 SECTION 1. That the Heading for Chapter 88, Title 67, Idaho Code, be,
20 and the same is hereby amended to read as follows:

22 IDAHO LAW ENFORCEMENT, AND FIREFIGHTING
23 AND EMS MEDAL OF HONOR
24 SECTION 2. That Section 67-8801, Idaho Code, be, and the same is hereby
25 amended to read as follows:
26 67-8801. IDAHO LAW ENFORCEMENT, AND FIREFIGHTING AND EMS MEDAL OF HONOR
27 ESTABLISHED. There is hereby established a decoration of the Idaho law
28 enforcement, and firefighting and EMS medal of honor with accompanying ribbons
29 and appurtenances for award by the governor in the name of the state to any
30 law enforcement officer, or firefighter or EMS provider who has been killed or
31 seriously injured in the performance of duty, or who has been distinguished by
32 exceptionally meritorious conduct, upon nomination of the Idaho law enforce-
33 ment, and firefighting and EMS medal of honor commission.
34 SECTION 3. That Section 67-8802, Idaho Code, be, and the same is hereby
35 amended to read as follows:
36 67-8802. IDAHO LAW ENFORCEMENT, AND FIREFIGHTING AND EMS MEDAL OF HONOR
37 COMMISSION CREATED -- MEMBERSHIP -- ESTABLISHMENT OF QUALIFICATIONS FOR AWARD.
38 (1) There is hereby created in the office of the governor the Idaho law
39 enforcement, and firefighting and EMS medal of honor commission, hereafter

1 referred to as the commission, which shall nominate candidates for the award
2 of the Idaho law enforcement, and firefighting and EMS medal of honor. The
3 commission shall consist of one (1) representative from each of the following:
4 the office of the governor, the office of the attorney general, the Idaho
5 prosecuting attorneys association, the Idaho chiefs of police association, the
6 Idaho fire chiefs association, the Idaho sheriffs' association, the Idaho
7 peace officers association, the Idaho department of health and welfare bureau
8 of emergency medical services and the peace officers standards and training
9 council. Members of the commission shall be appointed by the governor and
10 shall each serve for a term of four (4) years.
11 (2) The attorney general or his designee shall serve as chair of the com-
12 mission and shall designate a secretary for the commission.
13 (3) The commission shall meet annually, or at the call of the chair, to
14 consider candidates for nomination. Commission meetings may be conducted via
15 teleconference.
16 (4) The commission shall adopt rules establishing the qualifications for
17 the Idaho law enforcement, and firefighting and EMS medal of honor and the
18 protocol governing the decoration, and other rules necessary to carry out the
19 purposes of this chapter.
20 SECTION 4. That Section 67-8803, Idaho Code, be, and the same is hereby
21 amended to read as follows:
22 67-8803. WHEN AND BY WHOM AWARDED. The Idaho law enforcement, and fire-
23 fighting and EMS medal of honor shall be awarded by the governor to the recip-
24 ients during the national law enforcement recognition week. The governor may
25 delegate the awarding of the medal to the lieutenant governor or the attorney
26 general.
27 SECTION 5. That Section 67-8804, Idaho Code, be, and the same is hereby
28 amended to read as follows:
29 67-8804. POSTHUMOUS AWARD. The Idaho law enforcement, and firefighting
30 and EMS medal of honor may be awarded posthumously by presentation to a repre-
31 sentative of the deceased as may be deemed appropriate by the governor or the
32 designees specified in section 67-8803, Idaho Code.
33 SECTION 6. That Section 67-8805, Idaho Code, be, and the same is hereby
34 amended to read as follows:
35 67-8805. DESIGN AND COST. The decoration of the Idaho law enforcement,
36 and firefighting and EMS medal of honor shall be cast in bronze or other
37 metal. The design of the medal shall incorporate the great seal of the state
38 of Idaho with other insignia as deemed appropriate by the law enforcement, and
39 firefighting and EMS medal of honor commission. The reverse of the decoration
40 shall be inscribed with the words: "For exceptionally honorable and meritori-
41 ous conduct in performing services as a law enforcement officer, or firefight-
42 er or EMS provider." The cost of the medal shall be paid by the agency whose
43 officer, or firefighter or EMS provider receives the medal. The family of a
44 recipient may request a second medal and may receive such medal upon payment
45 to the commission of the cost of the medal.
46 SECTION 7. That Chapter 88, Title 67, Idaho Code, be, and the same is
47 hereby amended by the addition thereto of a NEW SECTION, to be known and des-
48 ignated as Section 67-8806, Idaho Code, and to read as follows:

1 67-8806. DEFINITIONS. As used in this chapter:
2 (1) "EMS" means emergency medical services; and
3 (2) "Emergency medical services provider" or "EMS provider" means an
4 emergency medical services provider certified by the department of health and
5 welfare pursuant to sections 56-1011 through 56-1018B, Idaho Code, and an
6 ambulance-based clinician as defined in the rules governing emergency medical
7 services as adopted by the department of health and welfare.
STATEMENT OF PURPOSE
RS 14844
This bill makes emergency medical service providers eligible
for the Idaho Law Enforcement and Firefighting Medal of Honor.
Emergency medical service providers make a significant
contribution to their communities and take many risks in the line
of duty. Adding them to the Idaho Law Enforcement and
Firefighting Medal of Honor will acknowledge the contributions of
these dedicated individuals.
