]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-eighth Legislature First Regular Session - 2005IN THE SENATE SENATE BILL NO. 1140 BY HEALTH AND WELFARE COMMITTEE 1 AN ACT 2 RELATING TO FAMILY PLANNING; AMENDING CHAPTER 2, TITLE 56, IDAHO CODE, BY THE 3 ADDITION OF A NEW SECTION 56-209n, IDAHO CODE, TO SET FORTH LEGISLATIVE 4 FINDINGS, TO PROVIDE THAT THE DIRECTOR OF THE DEPARTMENT OF HEALTH AND 5 WELFARE SHALL APPLY FOR A FAMILY PLANNING DEMONSTRATION WAIVER, TO REQUIRE 6 THE DIRECTOR TO ESTABLISH BASELINE BIRTHRATES AND TO PROVIDE A REPORT TO 7 THE LEGISLATURE AND TO DEFINE TERMS. 8 Be It Enacted by the Legislature of the State of Idaho: 9 SECTION 1. That Chapter 2, Title 56, Idaho Code, be, and the same is 10 hereby amended by the addition thereto of a NEW SECTION, to be known and des- 11 ignated as Section 56-209n, Idaho Code, and to read as follows: 12 56-209n. FAMILY PLANNING DEMONSTRATION WAIVER. (1) The legislature hereby 13 finds and declares that: 14 (a) The appropriate use of effective contraceptive methods reduces the 15 rate at which women have unintended or untimely pregnancies; 16 (b) Low-income women have statistically high rates of unintended or 17 untimely pregnancies; 18 (c) Women whose prenatal care is paid for by medicaid are significantly 19 more likely than other low-income women to report an unintended pregnancy 20 resulting in a live birth; 21 (d) Unintended or untimely pregnancies are associated with delayed or 22 insufficient prenatal care, which often results in poor birth outcomes and 23 more costly pregnancies and increased health care costs; 24 (e) It is anticipated that family planning coverage for low-income women 25 will lead to a decline in unintended pregnancies as well as a decline in 26 the rates of miscarriages, stillbirths and abortions; and 27 (f) Planned pregnancies result in healthier babies. 28 (2) The director of the department of health and welfare is hereby 29 directed to apply for a demonstration waiver from the centers for medicare and 30 medicaid services under section 1115 of the social security act for the pur- 31 pose of expanding family planning services to eligible families and to eligi- 32 ble women who are already enrolled in medicaid but who are not currently cov- 33 ered for family planning health care services. 34 (3) The director shall establish a baseline birthrate based upon a three 35 (3) year average before instituting the demonstration project and shall pro- 36 vide a report to the legislature following the three (3) year demonstration 37 project addressing demonstration results and any cost savings effected by the 38 project. 39 (4) As used in this section: 40 (a) "Contraceptive supplies" means contraceptives approved by the federal 41 food and drug administration (FDA). 42 (b) "Eligible families" means couples whose children are enrolled in the 43 CHIP Plan A, as defined in section 56-238, Idaho Code, and women who are 2 1 covered under the medicaid pregnant women and children (PWC) program. 2 (c) "Family planning services" includes medical services prescribed or 3 performed by an independent licensed physician or a nurse practitioner, 4 certified nurse midwife, or physician assistant and includes diagnosis, 5 treatment, contraceptive supplies, related counseling and restricted ster- 6 ilization. "Family planning services" does not include abortion services.
STATEMENT OF PURPOSE RS 14904 This legislation would expand family planning health care services in Idaho to low income women, age nineteen and older who are enrolled in the Medicaid Pregnant Women & Children Program (PWC), and women and men whose children are enrolled in the Chilren s Health Insurance Program (CHIP) Plan A. FISCAL NOTE Federal Medicaid program provides an enhanced match rate of 90:10 (or $9 federal dollars for each state dollar) for family planning services. Extending this benefit to income-eligible women who are already enrolled in the Medicaid Pregnant Women and Children Program, and women and men who have children enrolled in the Children s Health insurance program (CHIP, plan A) would require an initial investment in start up costs. Because Medicaid currently covers 38% of all births in Idaho, the state of Idaho would realize an estimated cost savings after two years due to a decrease in unplanned pregnancies.
