1 AN ACT
2 RELATING TO CERTIFICATED EMPLOYEES OF A PUBLIC SCHOOL DISTRICT; AMENDING SEC-
3 TION 33-514A, IDAHO CODE, TO SPECIFY CONDITIONS FOR THE ISSUANCE OF A LIM-
4 ITED ONE YEAR CONTRACT.
5 Be It Enacted by the Legislature of the State of Idaho:
6 SECTION 1. That Section 33-514A, Idaho Code, be, and the same is hereby
7 amended to read as follows:
8 33-514A. ISSUANCE OF LIMITED CONTRACT -- CATEGORY 1 CONTRACT. After
9 August 1, the board of trustees may exercise the option of employing certified
10 personnel on a one (1) year limited contract, which may also be referred to as
11 a category 1 contract consistent with the provisions of section 33-514, Idaho
12 Code, only if:
13 (1) A vacancy in a certified position has been created by the granting of
14 a leave of absence; or
15 (2) A vacancy in a certified position has been created as a result of a
16 resignation or retirement, for which notice was received subsequent to August
17 1 of that year; or
18 (3) A vacancy in a certified position has been created due to an emer-
19 gency situation and for which the originally employed certificate holder is
20 expected to return at a future date.
21 Such a contract is specifically offered for the limited duration of the ensu-
22 ing school year, and no further notice is required by the district to termi-
23 nate the contract at the conclusion of the contract year.

2 On page 1 of the printed bill, in line 20, delete "." and insert: "; or
3 (4) A new position is created as the result of unanticipated student
4 enrollment increases; or
5 (5) A school district certifies to the department of education that a
6 sufficient pool of quality candidates for a position or positions was not
7 available prior to August 1; or
8 (6) Other reasons as may be approved by the state department of
9 education.".

STATEMENT OF PURPOSE
RS 14930
The purpose of this legislation is to amend Idaho Code 33-514A to
define the situations under which a school district may issue a
limited one (1) year contract, which may also be referred to as a
category 1 contract.
