SCHOLARSHIPS - Amends existing law to provide reference to Iraq and
Afghanistan; to place a limit on the length of time educational benefits
shall be extended to a qualified dependent; to provide proper terminology;
to provide that application for eligibility shall be made to the State
Board of Education and the Board of Regents of the University of Idaho or
the State Board of Vocational-Technical Education; and to provide duties of
the State Board of Education and the Board of Regents of the University of
Idaho and the State Board of Vocational-Technical Education for verifying

  1                                        AN ACT
  2    RELATING TO SCHOLARSHIPS AND THE STATE BOARD OF  EDUCATION;  AMENDING  SECTION
  3        33-4302,  IDAHO  CODE,  TO  PROVIDE  REFERENCE TO IRAQ AND AFGHANISTAN, TO
  4        PLACE A LIMIT ON THE LENGTH OF TIME EDUCATIONAL BENEFITS SHALL BE EXTENDED
  5        TO A QUALIFIED DEPENDENT, TO PROVIDE PROPER TERMINOLOGY, TO  PROVIDE  THAT
  6        APPLICATION  FOR ELIGIBILITY SHALL BE MADE TO THE STATE BOARD OF EDUCATION
  7        AND THE BOARD OF REGENTS OF THE UNIVERSITY OF IDAHO OR THE STATE BOARD  OF
  8        VOCATIONAL-TECHNICAL  EDUCATION,  TO  PROVIDE DUTIES OF THE STATE BOARD OF
  9        EDUCATION AND THE BOARD OF REGENTS OF THE  UNIVERSITY  OF  IDAHO  AND  THE
 10        STATE  BOARD  OF VOCATIONAL-TECHNICAL EDUCATION FOR VERIFYING AND COMMUNI-
 11        CATING ELIGIBILITY FINDINGS AND TO MAKE A TECHNICAL CORRECTION.
                                                                        
 12    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 13        SECTION 1.  That Section 33-4302, Idaho Code, be, and the same  is  hereby
 14    amended to read as follows:
                                                                        
 15        33-4302.  SCHOLARSHIPS -- STATE AID. (1)  Any child dependent of any Idaho
 16    citizen who is a resident of the state of Idaho on or after the effective date
 17    of  this  act  and  who  has been determined by the federal government to be a
 18    prisoner of war or missing in action or to have died  of  injuries  or  wounds
 19    sustained  in  action  in  southeast  Asia,  including Korea, or in Iraq or in
 20    Afghanistan or who shall become so hereafter, in any area of armed conflict in
 21    which the United States is a party, shall be admitted  to  attend  any  public
 22    institution  of  higher education or public professional-technical school col-
 23    lege within the state of Idaho without the necessity  of  paying  tuition  and
 24    fees  therefor;  that such student shall be provided with books, equipment and
 25    supplies necessary for pursuit of such program of  enrollment  not  to  exceed
 26    five  hundred  dollars  ($500) per quarter, semester, intensified semester, or
 27    like educational period; that such student shall be furnished on-campus  hous-
 28    ing and subsistence for each month he is enrolled under this program and actu-
 29    ally  resides  in such on-campus facility; provided, however, that such educa-
 30    tional benefits shall not exceed a total of thirty-six (36) months or four (4)
 31    nine (9) month periods;. Pprovided further, that such child educational  bene-
 32    fits shall extend for a period of ten (10) years after achieving a high school
 33    diploma  or its equivalency, or for a period of ten (10) years after the event
 34    giving rise to the eligibility for the scholarship, whichever is longer.
 35        (2)  The dependent shall meet such  other  educational  qualifications  as
 36    such  institution of higher education or professional-technical school college
 37    has established for other prospective students of this state.
 38        (3)  Application for eligibility under this section shall be made  to  the
 39    state  board  of education and the board of regents of the university of Idaho
 40    or the state board of vocational-technical education. The board  shall  verify
 41    the  eligibility  of  the  dependent  and  communicate such eligibility to the
 42    dependent and the affected institution or college.
 43        (4)  Affected institutions shall in their preparation  of  future  budgets

  1    include  therein costs resultant from such tuition, fee, book, equipment, sup-
  2    ply, housing and subsistence loss for reimbursement  thereof  from  appropria-
  3    tions of state funds.
  4        (5)  Applicants  for  the scholarship program herein prescribed shall pro-
  5    vide institutional administrative personnel with documentation of their rights
  6    under this act.

Statement of Purpose / Fiscal Impact



                       STATEMENT OF PURPOSE

                            RS 15016C1

This bill provides for a scholarship for dependents of
Idaho's members of the military service who are killed or missing
during the conflict in Iraq.  It provides for scholarships for
dependents to include children and spouses.


                           FISCAL NOTE

The fiscal impact is dependent upon the total number of
Idaho's fallen heroes who give the supreme sacrifice to their
state and nation during the war in Iraq.  A fiscal impact is
expected of $5,100 per student per year of scholarship.  The cost
to the State General Fund is expected to be approximately $23,000
for each Idaho casualty.
