  1                                        AN ACT
  2    RELATING TO PODIATRY; AMENDING SECTION 54-602, IDAHO CODE, TO REVISE THE DEFI-
  3        NITION FOR SURGICAL TREATMENT, TO REQUIRE ADVANCED SURGICAL PROCEDURES  TO
  4        BE  PERFORMED  IN CERTAIN HOSPITALS OR SURGICAL CENTERS, TO PROVIDE A CODE
  5        REFERENCE, TO REVISE THE DEFINITION FOR PODIATRIST  AND TO MAKE  TECHNICAL
  6        CHANGES.
                                                                        
  7    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  8        SECTION  1.  That  Section  54-602, Idaho Code, be, and the same is hereby
  9    amended to read as follows:
                                                                        
 10        54-602.  PODIATRY DEFINED. (1) Podiatry shall, for the purpose of this act
 11    chapter, mean the diagnosis and mechanical, electrical, medical, physical  and
 12    surgical  treatment  of ailments of the human foot and leg, and the casting of
 13    feet for the  purpose  of  preparing  or  prescribing  corrective  appliances,
 14    prosthetics,  and/or the making of custom shoes for corrective treatment; pro-
 15    vided, however, that the casting of feet for preparing corrective  appliances,
 16    prosthetics and/or custom shoes may be permitted on the prescription of a duly
 17    licensed  person  in the healing arts in this state. Podiatrists shall be lim-
 18    ited in their practice to the human  foot  and  leg.  Surgical  treatment,  as
 19    herein  used,  shall  be  held  to mean the surgical treatment of the foot and
 20    ankle and those soft tissue structures below the knee governing  the  function
 21    of  the  foot  and  ankle, but shall not include the amputation of foot or the
 22    leg, surgery of the leg, or use of any anesthetic other than  local  anesthet-
 23    ics,  except that a knee joint, surgery of the bony structures proximal to the
 24    distal half of the tibia, or the administration or monitoring of general anes-
 25    thesia.
 26        (2)  Advanced surgical procedures, as determined by  the  state  board  of
 27    podiatry,  shall  be  performed in a licensed hospital or certified ambulatory
 28    surgical center where a peer review system is in place.
 29        (3)  A podiatrist may administer narcotics and medications in  the  treat-
 30    ment  of  ailments of the human foot and leg in the same manner as a physician
 31    and surgeon licensed to practice under chapter 18, title 54, Idaho Code.
 32        (4)  It is not the intent of this law section, and nothing herein shall be
 33    so construed, to prohibit the sale of noncustom built shoes that are  commonly
 34    sold by merchants in commercial establishments.
 35        (5)  A  podiatrist  is  defined as a natural person who practices podiatry
 36    and who within the scope of this act chapter is a physician and surgeon of the
 37    foot and ankle, and shall be referred to as a podiatric physician and surgeon;
 38    provided, further, that nothing within this chapter shall prohibit any  physi-
 39    cian  or  surgeon,  registered and licensed as such and authorized to practice
 40    under the laws of the state of Idaho, or  any  physician  or  surgeon  of  the
 41    United  States  army, navy or public health service when in actual performance
 42    of his duties, from practicing medicine and surgery.

Statement of Purpose / Fiscal Impact



                       STATEMENT OF PURPOSE

                            RS 15066C1

This legislation clarifies the surgery scope of practice for
podiatric physicians and surgeons to include procedures
reflecting current education, training and experience.  The
standard for performing advanced foot and ankle procedures in
hospitals and surgical centers, including a peer review process,
is identical to the standard required of medical doctors in
Idaho.



                           FISCAL NOTE

There is no fiscal impact on General or Dedicated funds.
