1 AN ACT
2 RELATING TO MOTORCYCLES; AMENDING SECTION 33-4904, IDAHO CODE, TO PROVIDE THAT
3 SIX DOLLARS OF EACH ANNUAL REGISTRATION FEE FOR A MOTORCYCLE SHALL BE
4 CREDITED TO THE MOTORCYCLE SAFETY PROGRAM FUND; AMENDING SECTION 49-401A,
5 IDAHO CODE, TO PROVIDE CORRECT CODE REFERENCES; AMENDING SECTION 49-402,
6 IDAHO CODE, TO INCREASE THE REGISTRATION FEE FOR MOTORCYCLES FROM NINE
7 DOLLARS TO FIFTEEN DOLLARS AND TO PROVIDE FOR DEPOSIT OF THE INCREASE TO
8 THE MOTORCYCLE SAFETY PROGRAM FUND; AND AMENDING SECTIONS 49-402B, 49-418D
9 AND 49-431, IDAHO CODE, TO PROVIDE A CORRECT CODE REFERENCE.
10 Be It Enacted by the Legislature of the State of Idaho:
11 SECTION 1. That Section 33-4904, Idaho Code, be, and the same is hereby
12 amended to read as follows:
13 33-4904. MOTORCYCLE SAFETY PROGRAM FUND. (1) The motorcycle safety pro-
14 gram fund is established in the state treasury and appropriated on a continual
15 basis to the department of education which shall administer the moneys. Money
16 in the fund shall only be used for administration and implementation of the
17 program, including reimbursement of entities which offer approved motorcycle
18 rider training courses.
19 (2) At the end of each fiscal year, moneys remaining in the motorcycle
20 safety program fund shall be retained in said fund and shall not revert to any
21 other general fund. The interest and income earned on money in the fund, after
22 deducting any applicable charges, shall be credited to and remain in the
23 motorcycle safety program fund.
24 (3) Revenue credited to the fund shall include one dollar ($1.00) of each
25 fee for a class A, B, C or D driver's license as provided in section 49-306,
26 Idaho Code.
27 (4) Revenue credited to the fund shall include six dollars ($6.00) of
28 each annual registration fee for a motorcycle as provided in section 49-402,
29 Idaho Code.
30 SECTION 2. That Section 49-401A, Idaho Code, be, and the same is hereby
31 amended to read as follows:
32 49-401A. OWNER TO SECURE REGISTRATION FROM A COUNTY ASSESSOR OR THE
33 DEPARTMENT. (1) Every owner of a motor vehicle, trailer or semitrailer who
34 intends to operate the vehicle upon any highway in this state shall before the
35 same is so operated, apply to a county assessor and obtain registration for
36 vehicles in sections 49-402(1) through (34), 49-402A, 49-402B and 49-422,
37 Idaho Code. All others shall be obtained from the department except as pro-
38 vided in subsection (2) of this section. Owners of vehicles specified in sec-
39 tion 49-426, Idaho Code, are exempt from the provisions of this section.
40 Owners of vehicles operating on a temporary basis as provided in sections
41 49-431(3), and 49-432, and 49-433, Idaho Code, are exempt from the provisions

1 of this section to the extent that the temporary permits in use are unexpired.
2 (2) Commercial vehicles in excess of twenty-six thousand (26,000) pounds
3 gross weight, farm and noncommercial vehicles in excess of sixty thousand
4 (60,000) pounds gross weight and all vehicles registered under section 49-435,
5 Idaho Code, shall be registered by the department. All other commercial, farm
6 and noncommercial vehicles and the vehicles in paragraphs (a), (b), and (c) of
7 this subsection, shall be registered by the county assessor.
8 (a) Motor vehicles equipped primarily to haul passengers on a commercial
9 basis, doing strictly an intrastate business, and having gross weights of
10 twenty-six thousand (26,000) pounds or less.
11 (b) Any farm vehicle or combination of vehicles where each vehicle or
12 combination of vehicles shall not exceed a gross weight of sixty thousand
13 (60,000) pounds.
14 (c) Nonresident vehicles or combination of vehicles owned by transient
15 labor used in hauling unprocessed agricultural products for hire and not
16 exceeding sixty thousand (60,000) pounds gross weight shall register their
17 vehicle for the appropriate gross weight scale for the annual fee if reg-
18 istered on or before June 30, and for one-half (1/2) the annual fee if not
19 registered until on or after July 1 of any year, with the assessor of the
20 county in which the owner resides.
21 (3) Commercial, farm and noncommercial vehicles of any weight doing
22 strictly an intrastate business may be registered by the county assessor by
23 mutual agreement between the department and the county.
24 SECTION 3. That Section 49-402, Idaho Code, be, and the same is hereby
25 amended to read as follows:
26 49-402. ANNUAL REGISTRATION. (1) The annual fee for operating each pickup
27 truck and each other motor vehicle having a maximum gross weight not in excess
28 of eight thousand (8,000) pounds shall be:
29 Vehicles one (1) and two (2) years old ............................ $48.00
30 Vehicles three (3) and four (4) years old ......................... $36.00
31 Vehicles five (5) and six (6) years old ........................... $36.00
32 Vehicles seven (7) and eight (8) years old ........................ $24.00
33 Vehicles over eight (8) years old ................................. $24.00
34 There shall be twelve (12) registration periods, starting in January for
35 holders of validation registration stickers numbered 1, and proceeding consec-
36 utively through December for holders of validation registration stickers num-
37 bered 12, each of which shall start on the first day of a calendar month and
38 end on the last day of the twelfth month from the first day of the beginning
39 month. Registration periods shall expire midnight on the last day of the reg-
40 istration period in the year designated by the validation registration
41 sticker. The numeral digit on the validation registration stickers shall, as
42 does the registration card, fix the registration period under the staggered
43 plate system of Idaho for the purpose of reregistration and notice of expira-
44 tion.
45 A vehicle that has once been registered for any of the above designated
46 periods shall, upon reregistration, be registered for the period bearing the
47 same number, and the registration card shall show and be the exclusive proof
48 of the expiration date of registration and licensing. Vehicles may be ini-
49 tially registered for less than a twelve (12) month period, or for more than a
50 twelve (12) month period, and the fee prorated on a monthly basis if the frac-
51 tional registration tends to fulfill the purpose of the monthly series regis-
52 tration system.
53 (2) For all school buses operated either by a nonprofit, nonpublic school

1 or operated pursuant to a service contract with a school district for trans-
2 porting children to or from school or in connection with school approved
3 activities, the annual fee shall be twenty-four dollars ($24.00).
4 (3) For all motorcycles and all-terrain vehicles operated upon the public
5 highways the annual fee shall be nine dollars ($9.00). For operation of an
6 all-terrain vehicle or motorcycle off the public highways, the fee specified
7 in section 67-7122, Idaho Code, shall be paid. Registration exemptions pro-
8 vided in section 49-426(2) and (3), Idaho Code, apply to all-terrain vehicles
9 and motorcycles used for the purposes described in subsections (2) and (3) of
10 section 49-426, Idaho Code.
11 (4) For all motorcycles operated upon the public highways the annual fee
12 shall be fifteen dollars ($15.00), six dollars ($6.00) of which shall be
13 deposited to the credit of the motorcycle safety program fund established in
14 section 33-4904, Idaho Code. For operation of a motorcycle off the public
15 highways, the fee specified in section 67-7122, Idaho Code, shall be paid.
16 Registration exemptions provided in section 49-426(2) and (3), Idaho Code,
17 apply to motorcycles used for the purposes described in subsections (2) and
18 (3) of section 49-426, Idaho Code.
19 (5) For all motor homes the fee shall be as specified in subsection (1)
20 of this section and shall be in addition to the fees provided for in section
21 49-445, Idaho Code.
22 (56) Registration fees shall not be subject to refund.
23 (67) A financial institution or repossession service contracted to a
24 financial institution repossessing vehicles under the terms of a security
25 agreement shall move the vehicle from the place of repossession to the finan-
26 cial institution's place of business on a repossession plate. The repossession
27 plate shall also be used for demonstrating the vehicle to a prospective pur-
28 chaser for a period not to exceed ninety-six (96) hours. The registration fees
29 for repossession plates shall be as required in subsection (1) of this section
30 for a vehicle one (1) and two (2) years old. All other fees required under
31 chapter 4, title 49, Idaho Code, shall be in addition to the registration fee.
32 The repossession plate shall be issued on an annual basis by the department.
33 (78) In addition to the annual registration fee in this section, there
34 shall be an initial program fee of twenty-five dollars ($25.00) and an annual
35 program fee of fifteen dollars ($15.00) for all special license plate programs
36 for those license plates issued pursuant to sections 49-404A, 49-407, 49-408,
37 49-409, 49-414, 49-416, 49-418 and 49-418D, Idaho Code. For special plates
38 issued pursuant to sections 49-406 and 49-406A, Idaho Code, there shall be an
39 initial program fee of twenty-five dollars ($25.00) but there shall be no
40 annual renewal fee. For special plates issued pursuant to sections 49-416A,
41 49-417, 49-417A, 49-417B, 49-417C, 49-418A, 49-418B, 49-418C, 49-419, 49-419A,
42 49-419B, 49-419C, 49-419D, 49-420, 49-420A, 49-420B, 49-420C, 49-420D, 49-420E
43 and 49-420G, Idaho Code, there shall be an initial program fee of thirty-five
44 dollars ($35.00) and an annual program fee of twenty-five dollars ($25.00).
45 The fees contained in this subsection shall be applicable to all new special
46 plate programs. The initial program fee and the annual program fee shall be
47 deposited in the state highway account and shall be used to fund the cost of
48 administration of special license plate programs, unless otherwise specified
49 by law.
50 SECTION 4. That Section 49-402B, Idaho Code, be, and the same is hereby
51 amended to read as follows:
52 49-402B. OPTIONAL BIENNIAL REGISTRATION. (1) At the option of the appli-
53 cant, any vehicle registered under the provisions of section 49-402(1) through

1 (56), Idaho Code, may be registered for a period of two (2) years for a fee
2 that is double the fee currently assessed for annual registration of the vehi-
3 cle in section 49-402, Idaho Code.
4 (2) If any vehicle registered under a special license plate program is
5 registered for a two (2) year period as provided in this section, the regis-
6 trant shall also be required to pay the special programs fees for a two (2)
7 year period.
8 (3) The additional fee collected for emergency medical services pursuant
9 to section 49-452, Idaho Code, shall also be doubled for any registration
10 issued under the provisions of this section.
11 (4) The administrative fee collected for issuance of a motor vehicle reg-
12 istration shall be the same as for an annual registration and shall not be
13 doubled or in any way increased solely because of registration under the pro-
14 visions of this section.
15 SECTION 5. That Section 49-418D, Idaho Code, be, and the same is hereby
16 amended to read as follows:
17 49-418D. MILITARY VETERAN MOTORCYCLE LICENSE PLATE. (1) On and after Jan-
18 uary 1, 2005, any person who is the owner of a motorcycle registered under the
19 provisions of section 49-402, Idaho Code, may apply for and upon department
20 approval receive a military veteran motorcycle license plate in lieu of a reg-
21 ular motorcycle license plate.
22 (2) Proof of being a current or former member of the United States armed
23 forces must be furnished to the department before a military veteran motor-
24 cycle plate will be issued. Acceptable proof shall be a copy of form DD214 or
25 an equivalent document or statement from the department of veterans affairs.
26 (3) In addition to the annual registration fee required in section
27 49-402(34), Idaho Code, the applicant shall be charged a fee of twenty-five
28 dollars ($25.00) for the initial issuance of a plate, and fifteen dollars
29 ($15.00) upon each succeeding annual registration. Ten dollars ($10.00) of the
30 initial program fee and ten dollars ($10.00) of the annual program fee shall
31 be deposited in the state highway account and shall be used to fund the cost
32 of administration of this special motorcycle license plate program. Fifteen
33 dollars ($15.00) of the initial program fee and five dollars ($5.00) of the
34 annual program fee shall be deposited to the veterans cemetery maintenance
35 fund created in section 65-107, Idaho Code, to operate and maintain a state
36 veterans cemetery.
37 (4) Whenever title or interest in a motorcycle registered under the pro-
38 visions of this section is transferred or assigned, the owner may transfer the
39 special plate to another motorcycle upon payment of the required transfer
40 fees. The owner may only display the plate on another motorcycle upon receipt
41 of the new registration from the department.
42 (5) The military veteran motorcycle license plate shall be of a color and
43 design:
44 (a) In accordance with the provisions of section 49-402C, Idaho Code,
45 except that there shall be no decals to indicate the veteran's branch of
46 service or the period of duty served; and
47 (b) The plate shall display the words "Scenic Idaho" at the top and
48 "Veteran" at the bottom of the plate; and
49 (c) The license plate design shall comply with all applicable rules of
50 the department, and shall include a separate and distinct numbering sys-
51 tem; and
52 (d) The design, color, and numbering system shall be subject to approval
53 of the department.

1 SECTION 6. That Section 49-431, Idaho Code, be, and the same is hereby
2 amended to read as follows:
3 49-431. ASSIGNMENT OR TRANSFER OF INTEREST -- PROCEDURE. (1) Whenever the
4 owner of a vehicle registered under the provisions of sections 49-402 and
5 49-402A, Idaho Code, transfers or assigns his title or interest thereto, the
6 registration card and license plate shall remain with and in the possession of
7 the transferor, and before the license plate shall be displayed upon another
8 vehicle owned by the transferor, the transferor shall have that vehicle regis-
9 tered as provided for in section 49-401A, Idaho Code. The transfer fees col-
10 lected shall be paid to the county treasurer where the vehicle is registered
11 and deposited in the county current expense fund or in the state highway
12 account if the transfer is made by the department.
13 (a) For all vehicles registered under the provisions of section
14 49-402(1), Idaho Code, the transferor shall pay the registration fee as
15 specified in that subsection less the registration fee already paid, plus
16 a transfer fee of five dollars ($5.00). If the transferor shall have an
17 older vehicle to be registered, the transferor shall pay a transfer fee of
18 five dollars ($5.00).
19 (b) For vehicles registered in accordance with subsections (2) through
20 (45) of section 49-402, Idaho Code, the operating fee shall be the fee
21 specified in those subsections, plus a transfer fee of five dollars
22 ($5.00).
23 (c) For utility trailers registered under the provisions of section
24 49-402A, Idaho Code, the original registration shall continue until its
25 expiration date, upon payment of a transfer fee of five dollars ($5.00).
26 (2) For all vehicles registered under the fee schedule in section 49-434,
27 Idaho Code, except proportionally registered vehicles under section 49-435,
28 Idaho Code, the transferor shall pay the registration fee as specified in that
29 section less the registration fee already paid, plus a transfer fee of five
30 dollars ($5.00). No portion of the fees previously paid shall be subject to
31 refund if the license plates and registration are not transferred to another
32 vehicle or if the registration fee previously paid is greater than the new
33 fee.
34 (3) For all vehicles registered under section 49-435, Idaho Code, the
35 transferor shall pay the registration fee as specified in section 49-434,
36 Idaho Code, apportioned according to the provisions of section 49-435, Idaho
37 Code, less the apportioned fee previously paid plus a transfer fee of eight
38 dollars ($8.00). No portion of the registration fee previously paid shall be
39 subject to refund if the license plate or plates and registration are not
40 transferred to another vehicle or if the registration fee previously paid is
41 greater than the new fee.
42 (4) In the event of a transfer by operation of law of the title or inter-
43 est of an owner in and to a vehicle registered as specified in sections
44 49-402, 49-402A, 49-434 and 49-435, Idaho Code, as upon inheritance, devise or
45 bequest, order in bankruptcy or insolvency, execution sale, repossession upon
46 default in performing the terms of a lease or executory sales contract, or
47 otherwise, the registration shall expire and the registration card and plates
48 shall be surrendered to the department. The vehicle shall not be operated upon
49 the highways until and unless the person entitled thereto shall apply for and
50 obtain a new registration card and plates in accordance with the provisions of
51 section 49-401A, Idaho Code. However, an administrator, executor, trustee or
52 other representative of the owner, or a sheriff or other officer, or legal
53 representative of any such person may operate or cause to be operated any
54 vehicle upon the highway from the place of removal or place where formerly

1 kept by the owner to a place of keeping or storage, provided the place of
2 removal and place of destination are both located within the state of Idaho,
3 and after obtaining a written permit from the department of the local police
4 authorities having jurisdiction of the highways and upon displaying in plain
5 sight upon the vehicle a placard bearing the name and address of the person
6 authorizing and directing such movement, the placard to be plainly readable
7 from a distance of one hundred (100) feet during daylight.

11 ignated as Section 49-453, Idaho Code, and to read as follows:
12 49-453. MOTORCYCLE SAFETY PROGRAM FEE. A motorcycle safety program fee of
13 six dollars ($6.00) shall be collected in addition to each motorcycle regis-
14 tration fee assessed pursuant to section 49-402, Idaho Code. Such fees shall
15 be deposited to the motorcycle safety program fund established in section
16 33-4904, Idaho Code.".

Statement of Purpose

This legislation is needed to fund the STAR (Skills Training Advantage for Riders)
motorcycle safety program to allow for continued growth and reasonable tuition for
all Idahoans. The STAR program has grown an average compounded rate of 22% per
year since 1996, without an increase in base funding. More than 11,000 Idahoans
have been trained since 1996, with 2,016 trained in 2004.
The proposed $6 annual motorcycle registration increase (supported by motorcyclists
throughout the state) would allow the program to hire additional staff, rent physical
training sites and buy training motorcycles on a replacement schedule as well as
fund the increasing cost to provide cost affordable training.
The increase would start with the 2006 registration cycle in late 2005.
FISCAL IMPACT
There is no fiscal impact to the state General Fund or local government entities.
