1 AN ACT
2 APPROPRIATING MONEYS TO THE SUPERINTENDENT OF PUBLIC INSTRUCTION/STATE DEPART-
3 MENT OF EDUCATION FOR FISCAL YEAR 2006; LIMITING THE NUMBER OF FULL-TIME
4 EQUIVALENT POSITIONS; AND DIRECTING CERTAIN REALLOCATIONS OF FEDERAL
5 FUNDS.
6 Be It Enacted by the Legislature of the State of Idaho:
7 SECTION 1. There is hereby appropriated to the Superintendent of Public
8 Instruction/State Department of Education the following amounts to be expended
9 according to the designated expense classes from the listed funds for the
10 period July 1, 2005, through June 30, 2006:

39 SECTION 2. In accordance with Section 67-3519, Idaho Code, the State
40 Department of Education is authorized no more than one hundred twenty-four
41 (124) full-time equivalent positions at any point during the period July 1,
42 2005, through June 30, 2006, unless specifically authorized by the Governor.
43 The Joint Finance-Appropriations Committee will be notified promptly of any

1 increased positions so authorized.
2 SECTION 3. At the direction of the State Board of Education, and only to
3 the extent permitted by federal law, the state department shall utilize the
4 allocation adjustment process to reallocate up to $365,100 in federal grant
5 funds to the Idaho Virtual Academy, based on the Idaho Virtual Academy having
6 the status of a local education agency (LEA), beginning on July 1, 2003, for
7 the purposes of receiving federal grant funds.

The Fiscal Year 2006 appropriation for the Superintendent of Public Instruction/State Department of Education includes funding for the increased cost of employee health insurance. Nonstandard Adjustments include minor adjustments in interagency billings, and 1.85 FTP and $75,000 for the last year of an Albertson Foundation-funded study of high performing schools. The money and positions are funded on a one-time basis, and will be deleted in FY 2007, after the grant has expired. This appropriation also deletes the 10 positions associated with the Idaho Student Information Management System (ISIMS) program, since these positions had been funded with Albertson Foundation grant funds, and the Foundation has abandoned further funding and development of the project.
