]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-eighth Legislature First Regular Session - 2005IN THE SENATE SENATE JOINT RESOLUTION NO. 101 BY STATE AFFAIRS COMMITTEE 1 A JOINT RESOLUTION 2 PROPOSING AN AMENDMENT TO ARTICLE III OF THE CONSTITUTION OF THE STATE OF 3 IDAHO, BY THE ADDITION OF A NEW SECTION 28, ARTICLE III, TO PROVIDE THAT 4 ONLY A UNION OF ONE MAN AND ONE WOMAN SHALL BE VALID OR RECOGNIZED AS A 5 MARRIAGE IN THIS STATE AND TO PROVIDE THAT THIS STATE AND ITS POLITICAL 6 SUBDIVISIONS SHALL NOT CREATE OR RECOGNIZE A LEGAL STATUS SIMILAR TO THAT 7 OF MARRIAGE; STATING THE QUESTION TO BE SUBMITTED TO THE ELECTORATE; 8 DIRECTING THE LEGISLATIVE COUNCIL TO PREPARE THE STATEMENTS REQUIRED BY 9 LAW; AND DIRECTING THE SECRETARY OF STATE TO PUBLISH THE AMENDMENT AND 10 ARGUMENTS AS REQUIRED BY LAW. 11 Be It Resolved by the Legislature of the State of Idaho: 12 SECTION 1. That Article III of the Constitution of the State of Idaho be 13 amended by the addition thereto of a NEW SECTION, to be known and designated 14 as Section 28, Article III, of the Constitution of the State of Idaho and to 15 read as follows: 16 SECTION 28. MARRIAGE. Only a union of one man and one woman 17 shall be valid or recognized as a marriage in this state. This state 18 and its political subdivisions shall not create or recognize a legal 19 status similar to that of marriage. 20 SECTION 2. The question to be submitted to the electors of the State of 21 Idaho at the next general election shall be as follows: 22 "Shall Article III, of the Constitution of the State of Idaho be amended 23 by the addition of a new Section 28, to provide that only a union of one man 24 and one woman shall be valid or recognized as a marriage in this state and to 25 provide that this state and its political subdivisions shall not create or 26 recognize a legal status similar to that of marriage?". 27 SECTION 3. The Legislative Council is directed to prepare the statements 28 required by Section 67-453, Idaho Code, and file the same. 29 SECTION 4. The Secretary of State is hereby directed to publish this pro- 30 posed constitutional amendment and arguments as required by law.
STATEMENT OF PURPOSE RS 14485C1 The purpose of this resolution is to amend Article III of the Constitution of the State of Idaho to add a new section to provide that only a union of one man and one woman shall be valid or recognized as a marriage in this state and to provide that this state and its political subdivisions shall not create or recognize a legal status similar to that of marriage.
