]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-eighth Legislature First Regular Session - 2005IN THE SENATE SENATE RESOLUTION NO. 103 BY JUDICIARY AND RULES COMMITTEE 1 A SENATE RESOLUTION 2 PROVIDING FOR THE AMENDMENT OF RULE 47 OF THE RULES OF THE SENATE. 3 Be It Resolved by the Senate of the State of Idaho: 4 WHEREAS, the Senate deems it necessary and desirable to amend Rule 47 of 5 the Rules of the Senate. 6 NOW, THEREFORE, BE IT RESOLVED by the members of the Senate, assembled in 7 the First Regular Session of the Fifty-eighth Idaho Legislature, that Rule 47 8 of the Rules of the Senate be amended to read as follows: 9 RULE 47 10 General and Special Rules.--(A)If any rule of procedure contained in 11 these rules and having application to a particular situation or action appears 12 to be in conflict with another rule more general in nature, the special rule 13 shall apply in the situation specified. 14Constitution Inconsistent.--(B) If any laws or constitutional provisions15of the State of Idaho are inconsistent with these rules, the conflicting rule16shall defer to the law or constitutional provision.
STATEMENT OF PURPOSE RS 14613 The purpose of this resolution is to amend Senate Rule 47. Effectively it deletes (b). Without a doubt the Constitution of the State of Idaho is always the overriding instrument as compared with the Senate Rules, and the rules of the Senate do not require that statement. Additionally, the resolution provides for the Senate to reassert its right to establish by rule its policies and procedures without deferring its rule making power to another legislative body and the executive branch.
