Senate to provide that if the committee to whom a gubernatorial appointment
has been referred, does not submit a report to the whole Senate for
adoption, the appointment shall be deemed rejected and the Senate's consent

  1                                 A SENATE RESOLUTION
  2    STATING FINDINGS OF THE SENATE AND AMENDING RULE 42 RELATING TO  CONSIDERATION
  3        OF GUBERNATORIAL APPOINTMENTS.
                                                                        
  4    Be It Resolved by the Senate of the State of Idaho:
                                                                        
  5        WHEREAS,  the  Senate  desires  that Rule 42 of the Rules of the Senate be
  6    amended.
  7        NOW, THEREFORE, BE IT RESOLVED by the members of the Senate, assembled  in
  8    the  First Regular Session of the Fifty-eighth Idaho Legislature, that Rule 42
  9    of the Rules of the Senate be amended to read as follows:
                                                                        
 10                                       RULE 42
 11        Gubernatorial Appointments.--Any appointment by the Governor of the  State
 12    of Idaho which requires confirmation by the Senate shall be on the desk of the
 13    President  of  the  Senate  and announced therefrom while in session, not less
 14    than three legislative days before being acted upon by the  Senate,  excepting
 15    therefrom  any nomination received after the fifty-seventh day of the session;
 16    any appointee so chosen by the Governor may be examined by the  State  Affairs
 17    Committee  or  other  designated committee, which committee shall may submit a
 18    report to the whole Senate for adoption.
 19        Adoption by the Senate of the committee report, if any, shall be  affirma-
 20    tive action of the Senate on the confirmation of the appointee unless the com-
 21    mittee  report  contains no recommendation. If the committee does not submit a
 22    report to the whole Senate for  adoption,  the  appointment  shall  be  deemed
 23    rejected  and  the  Senate's consent shall be deemed not to have been given to
 24    the appointment.
 25        Any report of the committee recommending confirmation  of  an  appointment
 26    need  be  held  for  only  one  day when the recommendation for appointment or
 27    report of the appointment has been read across the desk more than  three  days
 28    previously.

The purpose of this legislation is amend Senate Rule 42 to provide that germane
committees of the Idaho Senate may vote to hold gubernatorial appointments in committee
and when that is done, the appointment shall be deemed rejected and the Senate's consent
shall be deemed to not have been given to the appointment.
