RIVER BED LEASING - Amends existing law relating to mineral rights on state
lands to provide that certain provisions authorizing the leasing of the
beds of the navigable rivers in Idaho shall apply to deposits in their

  1                                        AN ACT
  2    RELATING TO MINERAL RIGHTS IN STATE  LANDS;  AMENDING  SECTION  47-716,  IDAHO
  3        CODE,  TO  PROVIDE  THAT CERTAIN PROVISIONS AUTHORIZING THE LEASING OF THE
  4        BEDS OF THE NAVIGABLE RIVERS IN IDAHO SHALL APPLY  TO  DEPOSITS  IN  THEIR
  5        NATURAL STATE, DUMPS AND TAILINGS.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION  1.  That  Section  47-716, Idaho Code, be, and the same is hereby
  8    amended to read as follows:
                                                                        
  9        47-716.  APPLICABLE ONLY TO DEPOSITS IN  NATURAL  STATE  APPLICATION.  The
 10    provisions  of this chapter authorizing the leasing of the beds of the naviga-
 11    ble rivers in the state of Idaho shall apply only to deposits in their natural
 12    state, and shall not apply to dumps, and to tailings.

                       STATEMENT OF PURPOSE

                             RS 14652

The purpose of this legislation is to change Idaho Code 47-716,
allowing the leasing of beds of navigable rivers.


                            FISCAL NOTE

The State could potential save millions of dollars and could generate
taxes on millions of dollars.
