1 AN ACT
2 RELATING TO FUNERAL DIRECTORS; AMENDING SECTION 54-1109, IDAHO CODE, TO APPLY
3 ENDORSEMENT PROVISIONS TO FUNERAL DIRECTORS.
4 Be It Enacted by the Legislature of the State of Idaho:
5 SECTION 1. That Section 54-1109, Idaho Code, be, and the same is hereby
6 amended to read as follows:
7 54-1109. REQUIREMENTS FOR MORTICIAN LICENSE -- REQUIREMENTS FOR FUNERAL
8 DIRECTOR LICENSE -- LICENSE BY ENDORSEMENT. (1) The board shall issue to any
9 person a mortician's license to practice as a mortician and perform mortician
10 services within the state of Idaho who has complied with and fulfilled all of
11 the following requirements:
12 (a) Has attained the age of twenty-one (21) years.
13 (b) Is of good moral character.
14 (c) Has completed and received credit for at least sixty (60) semester
15 hours' or ninety (90) quarter-hours' instruction in a duly accredited col-
16 lege or university and has obtained at least a C grade average for all
17 courses of instruction; provided, however, at least three-fourths (3/4) of
18 all of such credits must be for courses in the fields of liberal arts,
19 business or science as defined and specified by the board of morticians.
20 (d) Has successfully completed a course in an embalming school accredited
21 by the American board of funeral service education, inc., or such other
22 embalming school as approved by the board of morticians.
23 (e) Has practiced as a licensed resident trainee in the state of Idaho
24 under the personal supervision of a licensed resident mortician for not
25 less than twelve (12) months, and has assisted in embalming at least
26 twenty-five (25) dead human bodies; provided, however, such practice as a
27 licensed resident trainee of the state of Idaho may be filled and per-
28 formed either before or after the required post-high school education.
29 (f) Has filed an application with the board as required by this chapter
30 and paid the required filing fee therefor.
31 (g) Has passed the required examination prepared and conducted by the
32 board of morticians. Provided further, that the board shall determine com-
33 pliance with all of the above qualifications, except this paragraph relat-
34 ing to examinations, at the time the applicant files his application as
35 hereinafter provided and before the examination is conducted by the board
36 of morticians.
37 (2) The board shall issue to any person a funeral director license to
38 practice as a funeral director and perform funeral director services within
39 the state of Idaho who has complied with and fulfilled all of the following
40 requirements:
41 (a) Has attained the age of twenty-one (21) years.
42 (b) Is of good moral character.
43 (c) Has completed and received at least sixty (60) semester hours' or

1 ninety (90) quarter-hours' instruction from a duly accredited college or
2 university and has obtained at least a C grade average for all courses of
3 instruction; provided, however, at least three-fourths (3/4) of all such
4 credits must be for courses in the fields of liberal arts, business or
5 science as defined and specified by the board.
6 (d) Has successfully completed at least fifteen (15) semester credit
7 hours or the equivalent from a mortuary college accredited by the American
8 board of funeral service education, inc., or such credits as are otherwise
9 approved by the board, with course of study to include business law, psy-
10 chology, sociology, funeral service counseling, funeral service management
11 and other classes that relate to conducting funeral business.
12 (e) Has practiced as a licensed trainee in the state of Idaho under the
13 personal supervision of a licensed mortician for not less than twelve (12)
14 months, and has assisted in making at least twenty-five (25) funeral
15 arrangements and in conducting at least twenty-five (25) funerals.
16 (f) Has successfully passed the required examination as established by
17 the rules of the board. An applicant shall not be qualified to take the
18 examination until all other requirements have been met.
19 (g) Has filed an application with the board as required by this chapter
20 and paid the required fees.
21 (3) Any person holding a current, valid license in another state or ter-
22 ritory having substantially similar requirements to those existing in this
23 state, may be granted a license without examination, provided:
24 (a) The applicant files with the board a certified statement from the
25 examining board of the state or territory in which the applicant holds his
26 license, verifying the license and showing the basis upon which the
27 license was granted; and
28 (b) The applicant pays the license fee; and
29 (c) The applicant satisfies the board that he understands the laws and
30 rules of this state as to funeral service.
31 (4) A person holding a current, valid license in another state or terri-
32 tory with requirements significantly lower than those of this state who has at
33 least five (5) consecutive years of experience as a licensee in the other
34 state or territory prior to application, may apply for a license to practice
35 in this state without meeting the full requirements of subsection (1) or (2)
36 of this section. Upon payment of the license fee and passing such test of pro-
37 ficiency as the board shall require including, but not limited to, a knowledge
38 of the laws and administrative rules of this state as to funeral service, the
39 board shall grant a license.
STATEMENT OF PURPOSE
RS 14399
Amend section 54-1109(4), Idaho Code, to include funeral directors
in the endorsement requirements and to correct a typographical
error.
FISCAL IMPACT
There is no fiscal impact on general or dedicated funds.
