  2    RELATING TO FISH AND GAME; AMENDING SECTION 36-416, IDAHO CODE, TO REVISE  THE
  3        SCHEDULE  OF  LICENSE FEES; AMENDING SECTION 36-306, IDAHO CODE, TO REVISE
  4        THE VENDOR ISSUANCE FEE; AND  AMENDING  SECTION  36-602,  IDAHO  CODE,  TO
  5        REVISE THE EXPIRATION DATE FOR TAXIDERMIST AND FUR BUYER'S LICENSES.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION  1.  That  Section  36-416, Idaho Code, be, and the same is hereby
  8    amended to read as follows:

 10        SECTION 2.  That Section 36-306, Idaho Code, be, and the  same  is  hereby
 11    amended to read as follows:
                                                                        
 12        36-306.  VENDOR FEE. All persons authorized to issue licenses shall charge
 13    a  vendor  issuance  fee  of one dollar and fifty seventy-five cents ($1.5075)
 14    upon all licenses issued, not less than one-half (1/2) to be retained by  them
 15    as  compensation for the issuance of such licenses as may be specified by con-
 16    tract between the license vendor and the department for license issuance  ser-
 17    vices  performed  by  the  vendor;  provided that the vendor fee for an eighth
 18    class license as that license is provided  for  in  section  36-406(f),  Idaho
 19    Code,  shall be equal to one-half (1/2) the total vendor fee had each license,
 20    tag, permit or stamp been separately issued; provided  further,  the  director
 21    may waive the vendor issuance fee for a license not issued by the department's
 22    computerized  licensing  system.  The amount of the vendor fee retained by the
 23    department shall be deposited in the fish and game account and shall  be  used
 24    to  help offset the cost of the computerized licensing system. Such vendor fee
 25    shall be charged in addition to the regular cost of the license.  However,  in
 26    the  case  of crayfish or minnow traps, beaver, bobcat or lynx tags the vendor
 27    fee shall be charged for each issuance of tags for each species regardless  of
 28    the number of tags issued in said transaction. Proceeds from department issued
 29    licenses  may  be  set  aside for the department's special operations program,
 30    including citizens against poaching.
                                                                        
 31        SECTION 3.  That Section 36-602, Idaho Code, be, and the  same  is  hereby
 32    amended to read as follows:
                                                                        
 33        36-602.  LICENSE  FEES  --  EXPIRATION.  (a)  Resident Taxidermist and Fur
 34    Buyer's License. A fee as specified in section 36-416, Idaho  Code,  shall  be
 35    charged for a resident taxidermist and fur buyer's license.
 36        (b)  Nonresident  Taxidermist and Fur Buyer's License.  Nonresidents shall
 37    pay an amount equal to that charged Idaho residents in the state of the appli-
 38    cant for the license. In cases where the state of the applicant requires  more
 39    than one (1) license, the cost shall  be the total of all licenses required of
 40    an  Idaho  resident to engage in similar activities in the state of the appli-
 41    cant. In no case shall this amount be less than the fee as specified  in  sec-
 42    tion  36-416,  Idaho  Code. The department shall promulgate rules implementing
 43    the provisions of this section.
 44        (c)  The expiration date for taxidermist and fur buyer's licenses shall be
 45    June 30 of the fifth year next following the date of issuance.

Statement of Purpose / Fiscal Impact


                       STATEMENT OF PURPOSE

                             RS 14826

 This bill would provide a small fee adjustment effective the
start of FY 06. The last fee increase was effective on May 1,
2000. These fees are necessary to continue the department
activities sportsmen are familiar with and support. It would also
provide about $611,000 for improving activities that sportsmen
have said are very important but which the department needs to
improve, such as access to private land, fish and wildlife
enforcement, communications to and from sportsmen about wildlife
and mule deer habitat restoration.
     Since 2000 the Department of Fish and Game has implemented
several "better business practices" to hold down expenses while
providing fishing, hunting, and trapping opportunities. The
proposed fee increase would provide enough funding to continue
services through June 30, 2006.


                          FISCAL NOTE

Based on current forecasts, the commission estimates that the FY
06ee adjustment would generate about $4.2 million more in FY 06
than was actually received two years earlier in FY 04. This
increase would fund the commission's FY 06 budget for the
department. It would also provide 25 cents per document to those
businesses that sell fish and game licenses to help offset their
expenses since 1995 when the current issuance fee was
established.
