]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-eighth Legislature First Regular Session - 2005IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 141 BY BUSINESS COMMITTEE 1 AN ACT 2 RELATING TO ELECTRICAL CONTRACTORS AND JOURNEYMEN; AMENDING SECTION 54-1003A, 3 IDAHO CODE, TO REQUIRE ELECTRICAL CONTRACTORS AND SPECIALTY ELECTRICAL 4 CONTRACTORS TO PROVIDE PROOF OF LIABILITY INSURANCE AND PROOF OF WORKER'S 5 COMPENSATION INSURANCE, IF APPLICABLE, PRIOR TO BEING ISSUED A LICENSE; 6 AND AMENDING SECTION 54-1013, IDAHO CODE, TO REQUIRE ELECTRICAL CONTRAC- 7 TORS AND SPECIALTY ELECTRICAL CONTRACTORS TO PROVIDE PROOF OF LIABILITY 8 INSURANCE AND PROOF OF WORKER'S COMPENSATION INSURANCE, IF APPLICABLE, 9 PRIOR TO BEING ISSUED A LICENSE AND TO MAKE TECHNICAL CORRECTIONS. 10 Be It Enacted by the Legislature of the State of Idaho: 11 SECTION 1. That Section 54-1003A, Idaho Code, be, and the same is hereby 12 amended to read as follows: 13 54-1003A. DEFINITIONS. (1) Electrical Contractor. Except as provided in 14 section 54-1016, Idaho Code, any person, partnership, company, firm, associa- 15 tion or corporation engaging in, conducting, or carrying on the business of 16 installing wires or equipment to carry electric current or installing appara- 17 tus to be operated by such current, or entering into agreements to install 18 such wires, equipment or apparatus, shall for the purpose of this act be known 19 as an electrical contractor. An electrical contractor, prior to being issued a 20 license, shall be required to provide proof of liability insurance in the 21 amount of three hundred thousand dollars ($300,000) and proof of worker's com- 22 pensation insurance if applicable. 23 (2) Journeyman Electrician. Except as provided in section 54-1016, Idaho 24 Code, and subsections (3), (4), (5) and (6) of this section, any person who 25 personally performs or supervises the actual physical work of installing elec- 26 tric wiring or equipment to convey electric current, or apparatus to be oper- 27 ated by such current, shall, for the purpose of this act, be known as a jour- 28 neyman electrician. 29 (3) Apprentice Electrician. Any person who, for the purpose of learning 30 the trade of journeyman electrician, engages in the installation of electric 31 wiring, equipment, or apparatus while under the constant on-the-job supervi- 32 sion of a qualified journeyman electrician shall, for the purpose of this act, 33 be known as an apprentice electrician. 34 (4) Maintenance Electrician. Any person who is regularly employed to ser- 35 vice, maintain or repair electrical apparatus, or to make minor repairs or 36 alterations to existing electrical wires or equipment located on his 37 employer's premises shall, for the purpose of this act, be known as a mainte- 38 nance electrician. 39 (5) Master Electrician. A person who has the necessary qualifications, 40 training, experience and technical knowledge to plan, layout or design the 41 installation of electrical wiring or equipment, or to supervise such planning, 42 layout, or design, and who performs or supervises such planning, layout or 43 design, shall, for the purpose of this act, be known as a master electrician. 2 1 (6) Specialty Electrician. A person having the necessary qualifications, 2 training, experience and technical knowledge to install, alter, repair and 3 supervise the installing, altering or repairing of special classes of electri- 4 cal wiring, apparatus or equipment within categories adopted by the board. 5 Specialty electricians shall perform work only within the scope of the spe- 6 cialty category for which the person is licensed. 7 (7) Specialty Electrical Contractor. Except as provided in section 8 54-1016, Idaho Code, any person, partnership, company, firm, association or 9 corporation engaging in, conducting or carrying on the business of installing, 10 altering or repairing special classes of electrical wiring, apparatus or 11 equipment within categories adopted by the board or entering into agreements 12 to perform such specialty work, shall for the purpose of this act be known as 13 a specialty electrical contractor. Specialty electrical contractors shall 14 perform work only within the scope of the specialty category for which the 15 contractor is licensed. A specialty electrical contractor, prior to being 16 issued a license, shall be required to provide proof of liability insurance in 17 the amount of three hundred thousand dollars ($300,000) and proof of worker's 18 compensation insurance if applicable. 19 (8) Specialty Electrical Trainee. Any person who, for the purpose of 20 learning the trade of a specialty electrician, engages in the installation of 21 electrical wiring, equipment or apparatus while under the constant on-the-job 22 supervision of a qualified specialty electrician shall, for the purpose of 23 this act, be known as a specialty electrical trainee. 24 SECTION 2. That Section 54-1013, Idaho Code, be, and the same is hereby 25 amended to read as follows: 26 54-1013. RENEWAL OF LICENSES. (1) A license once issued under thisact27 chapter, unless revoked or suspended as herein provided, may be renewed at any 28 time during the final month of the licensing period on the payment of the 29 renewal fee herein specified, proof of satisfaction of the continuing educa- 30 tion requirements as established by the electrical board, and provided that 31 all outstanding civil penalties, and permit or other fees, have been paid in 32 full, and all outstanding correction notices have been satisfactorily 33 resolved. For electrical contractors and specialty electrical contractors, 34 proof of liability insurance in the amount of three hundred thousand dollars 35 ($300,000) shall also be required, and proof of worker's compensation insur- 36 ance shall be required if applicable. 37 (2) Any license which has expired may be revived at any time within one 38 (1) year from the first day of the final month of the licensing period, by 39 payment of the revival fee herein specified, together with all outstanding 40 civil penalties, and permit or other fees and penalties, and upon proof that 41 outstanding correction notices have been satisfactorily resolved. For electri- 42 cal contractors and specialty electrical contractors, proof of liability 43 insurance in the amount of three hundred thousand dollars ($300,000) shall 44 also be required, and proof of worker's compensation insurance shall be 45 required if applicable. 46 (3) Certificates of competency issued prior to July 1, 1961, shall, for 47 the purpose of thisactchapter, be considered as licenses and may be renewed 48 or revived as herein provided.
STATEMENT OF PURPOSE RS 14810 At present, other bureaus in the Division of Building Safety, Plumbing and HVAC, require proof of financial protection for consumers. Many electrical contractors have specialty licenses within the Plumbing and HVAC bureaus and are required to provide proof of consumer financial protection for those specialty licenses. This legislation would make evidence of financial responsibility the same in the Division of Building Safety Bureaus. FISCAL NOTE There is no fiscal impact to the general fund.
