3 REPEALING SECTIONS 67-1901 THROUGH 67-1903, IDAHO CODE, RELATING TO STATE
4 PLANNING; AMENDING CHAPTER 19, TITLE 67, IDAHO CODE, BY THE ADDITION OF A
5 NEW SECTION 67-1901, TO SET FORTH PURPOSES; AMENDING CHAPTER 19, TITLE 67,
6 IDAHO CODE, BY THE ADDITION OF A NEW SECTION 67-1902, IDAHO CODE, TO
7 DEFINE TERMS; AMENDING CHAPTER 19, TITLE 67, IDAHO CODE, BY THE ADDITION
8 OF A NEW SECTION 67-1903, IDAHO CODE, TO PROVIDE FOR STRATEGIC PLANNING;
9 AMENDING CHAPTER 19, TITLE 67, IDAHO CODE, BY THE ADDITION OF A NEW SEC-
10 TION 67-1904, IDAHO CODE, TO PROVIDE FOR PERFORMANCE MEASUREMENT; AND
11 AMENDING CHAPTER 19, TITLE 67, IDAHO CODE, BY THE ADDITION OF A NEW SEC-
12 TION 67-1905, IDAHO CODE, TO PROVIDE FOR TRAINING.
13 Be It Enacted by the Legislature of the State of Idaho:
14 SECTION 1. That Sections 67-1901 through 67-1903, Idaho Code, be, and the
15 same are hereby repealed.
16 SECTION 2. That Chapter 19, Title 67, Idaho Code, be, and the same is
17 hereby amended by the addition thereto of a NEW SECTION, to be known and des-
18 ignated as Section 67-1901, Idaho Code, and to read as follows:
19 67-1901. PURPOSES. The purposes of sections 67-1901 through 67-1905,
20 Idaho Code, are to generate state agency planning and performance information
21 that can be used to:
22 (1) Improve state agency accountability to state citizens and lawmakers;
23 (2) Increase the ability of the legislature to assess and oversee agency
25 (3) Assist lawmakers with policy and budget decisions; and
26 (4) Increase the ability of state agencies to improve agency management
27 and service delivery and assess program effectiveness.
28 SECTION 3. That Chapter 19, Title 67, Idaho Code, be, and the same is
29 hereby amended by the addition thereto of a NEW SECTION, to be known and des-
30 ignated as Section 67-1902, Idaho Code, and to read as follows:
31 67-1902. DEFINITIONS. For purposes of sections 67-1901 through 67-1905,
32 Idaho Code:
33 (1) "Agency" means each department, board, commission, office and insti-
34 tution, educational or otherwise, except elective offices, in the executive
35 department of state government. "Agency" does not include legislative and
36 judicial branch entities.
37 (2) "Benchmark" or "performance target" means the agency's expected,
38 planned or intended result for a particular performance measure. This informa-
39 tion may come from an accepted industry standard for performance or from an
40 agency's careful study, research and/or analysis of the circumstances impact-
1 ing performance capabilities.
2 (3) "Core function" means a group of related activities serving a common
3 end of meeting the main responsibilities of the agency.
4 (4) "Goal" means a planning element that describes the broad condition,
5 state or outcome an agency or program is trying to achieve.
6 (5) "Major division" means an organizational group within the agency that
7 focuses on meeting one (1) or more of the agency's primary statutory responsi-
9 (6) "Objective" means a planning element that describes a specific condi-
10 tion, state or outcome that an agency or program is trying to achieve as a
11 step toward fulfilling its goals.
12 (7) "Performance measure" means a quantifiable indicator of an agency's
13 progress toward achieving its goals.
14 SECTION 4. That Chapter 19, Title 67, Idaho Code, be, and the same is
15 hereby amended by the addition thereto of a NEW SECTION, to be known and des-
16 ignated as Section 67-1903, Idaho Code, and to read as follows:
17 67-1903. STRATEGIC PLANNING. (1) Each state agency shall develop and sub-
18 mit to the division of financial management a comprehensive strategic plan for
19 the major divisions and core functions of that agency. The plan shall be based
20 upon the agency's statutory authority and, at a minimum, shall contain:
21 (a) A comprehensive outcome-based vision or mission statement covering
22 major divisions and core functions of the agency;
23 (b) Goals for the major divisions and core functions of the agency;
24 (c) Objectives and/or tasks that indicate how the goals are to be
26 (d) Performance measures, developed in accordance with section 67-1904,
27 Idaho Code, that assess the progress of the agency in meeting its goals in
28 the strategic plan, along with an indication of how the performance mea-
29 sures are related to the goals in the strategic plan;
30 (e) Benchmarks or performance targets for each performance measure for,
31 at a minimum, the next fiscal year, along with an explanation of the man-
32 ner in which the benchmark or target level was established; and
33 (f) An identification of those key factors external to the agency and
34 beyond its control that could significantly affect the achievement of the
35 strategic plan goals and objectives.
36 (2) The strategic plan shall cover a period of not less than four (4)
37 years forward including the fiscal year in which it is submitted, and shall be
38 updated annually.
39 (3) The strategic plan shall serve as the foundation for developing the
40 annual performance information required by section 67-1904, Idaho Code.
41 (4) When developing a strategic plan, an agency shall consult with the
42 appropriate members of the legislature, and shall solicit and consider the
43 views and suggestions of those persons and entities potentially affected by
44 the plan. Consultation with legislators may occur when meeting the requirement
45 of section 67-1904(7), Idaho Code.
46 (5) Strategic plans are public records and are available to the public as
47 provided in section 9-338, Idaho Code.
48 SECTION 5. That Chapter 19, Title 67, Idaho Code, be, and the same is
49 hereby amended by the addition thereto of a NEW SECTION, to be known and des-
50 ignated as Section 67-1904, Idaho Code, and to read as follows:
51 67-1904. PERFORMANCE MEASUREMENT. (1) Every fiscal year, as part of its
1 budget request, each agency shall prepare an annual performance report. The
2 report shall be comprised of two (2) parts:
3 (a) Part I shall contain basic program information for the prior four (4)
4 fiscal years including, at a minimum, statutory authority, fiscal year
5 revenue and expenditure information and any informative breakdowns, such
6 as amounts from different revenue sources, types of expenditures, and
7 costs per significant activity to meet agency goals, and data about the
8 number and types of cases managed and/or key services provided.
9 (b) Part II shall contain:
10 (i) Five (5) to ten (10) key quantifiable performance measures,
11 which clearly capture the agency's progress in meeting the goals of
12 its major divisions and core functions stated in the strategic plan
13 required in section 67-1903, Idaho Code. The goal(s) and strategies
14 to which each measure corresponds shall also be provided. More mea-
15 sures may be authorized or required by the germane committee chairs
16 through the process set forth in subsection (7) of this section.
17 (ii) Results for each measure for the prior four (4) fiscal years.
18 In situations where past data is not available because a new measure
19 is being used, the report shall indicate the situation.
20 (iii) Benchmarks or performance targets for each measure for, at a
21 minimum, the next fiscal year, and for each year of the four (4)
22 years of reported actual results.
23 (iv) Explanations, where needed, which provide context important for
24 understanding the measures and the results, and any other qualitative
25 information useful for understanding agency performance.
26 (v) Attestation from the agency director that the data reported has
27 been internally assessed for accuracy, and, to the best of the
28 director's knowledge, is deemed to be accurate.
29 (2) Each agency performance report shall be presented in a consistent
30 format, determined by the division of financial management, which allows for
31 easy review and understanding of the information reported.
32 (3) Each agency shall review the results of the performance measures com-
33 pared to benchmarks or performance targets and shall use the information for
34 internal management purposes.
35 (4) Each agency shall maintain reports and documentation that support the
36 data reported through the performance measures. This information shall be
37 maintained and kept readily available for each of the four (4) years covered
38 in the most recent performance report.
39 (5) The performance report shall be submitted by the agency to the divi-
40 sion of financial management and the budget and policy analysis office of the
41 office of legislative services by September 1 of each year. For reports sub-
42 mitted in calendar year 2005, agencies shall submit the performance report no
43 later than November 1. In accordance with this section, agency performance
44 reports shall be published each year as part of the executive budget document,
45 except that the performance reports submitted in 2005 shall be exempt from
46 this publishing requirement.
47 (6) The office of budget and policy analysis of the office of legislative
48 services may incorporate all or some of the information submitted under this
49 section in its annual legislative budget book.
50 (7) Each agency shall orally present the information from the performance
51 report to its corresponding senate and house of representatives germane com-
52 mittees each year unless a germane committee elects to have an agency present
53 such information every other year. The presentations shall consist of a review
54 of agency performance information and shall provide an opportunity for dia-
55 logue between the agency and the committees about the sufficiency and useful-
1 ness of the types of information reported. Following any discussion about the
2 information reported, the germane committees, in accordance with the require-
3 ments of this section, shall determine any changes to be made to the types of
4 information reported.
5 (8) If an agency and its corresponding germane committees determine that
6 it is not feasible to develop a quantifiable measure for a particular goal or
7 strategy, the germane committees may authorize an alternative form of measure-
9 (9) Senate and house of representatives germane committees should attempt
10 to meet jointly to hear and discuss an agency's performance report. If joint
11 meetings are not possible, agencies should attempt to achieve as much consen-
12 sus as possible between the committees regarding the types of information
13 reported, provided the number of measures reported may be increased, if
14 needed, to meet requests of the different committees.
15 SECTION 6. That Chapter 19, Title 67, Idaho Code, be, and the same is
16 hereby amended by the addition thereto of a NEW SECTION, to be known and des-
17 ignated as Section 67-1905, Idaho Code, and to read as follows:
18 67-1905. TRAINING. Strategic planning and performance measurement train-
19 ing shall be held for both state agencies and lawmakers as follows:
20 (1) The division of financial management shall coordinate training for
21 key agency personnel on the development, use and reporting of strategic plan-
22 ning and performance measurement information. The training shall be integrated
23 into current agency training programs and shall be offered and required for
24 agency staff at a frequency determined by the division of financial manage-
26 (2) The office of performance evaluations and the office of budget and
27 policy analysis of the office of legislative services shall coordinate train-
28 ing for legislators on the development and use of strategic planning and per-
29 formance measurement information. The training shall be offered at least once
30 every two (2) years to coincide with new legislative terms.
STATEMENT OF PURPOSE
This proposed legislation would eliminate strategic planning
and performance measurement requirements deemed as generally not
meeting legislative intent, and to establish new requirements
designed to improve the process.
The intent is to generate information that can be used to
improve state agency accountability, increase the ability of
state agencies to assess agency performance and make any needed

necessitate a small increase in time spent for both lawmakers and
agency officials. Offering training will require approximately
$10,000 every two years, $10,000 for the Office of Performance
Evaluation every 2 years, and $10,000 for the Department of
Financial Management every 2 years.
