SENATE BILL NO. 1002

1 AN ACT
2 RELATING TO SCHOOL TRANSPORTATION; AMENDING SECTION 33-1508, IDAHO CODE, TO
3 REMOVE A REQUIREMENT THAT PERSONS OPERATING SCHOOL BUSES HAVE A VALID DRI-
4 VER'S PERMIT ISSUED BY THE BOARD OF TRUSTEES.
5 Be It Enacted by the Legislature of the State of Idaho:
6 SECTION 1. That Section 33-1508, Idaho Code, be, and the same is hereby
7 amended to read as follows:
8 33-1508. OPERATION OF SCHOOL BUSES. (1) All school buses shall at all
9 times be operated in conformity with law and with rules of the Idaho state
10 police and the state board of education.
11 (2) No school bus shall:
12 (a) Cross any railroad track, or enter or cross any arterial highway
13 without first coming to a full stop. If any such crossing, intersection or
14 access be obscured by trees, buildings or other objects, or because of
15 wind, storm or fog, the school bus driver shall open such windows and
16 doors as will permit him to determine when it is safe to proceed;
17 (b) Be operated at any time for the transportation of pupils by any per-
18 son who does not have a current commercial driver's license (CDL) as spec-
19 ified in section 49-105, Idaho Code, a valid driver's permit issued by the
20 board of trustees, and the minimum training for bus drivers as prescribed
21 by the state board of education;
22 (c) Be operated at any time in excess of its maximum occupancy as deter-
23 mined by the manufacturer. Occupancy at no time shall exceed three (3)
24 persons in a seat.
STATEMENT OF PURPOSE
RS 14486
In the 2004 session, SB 1323 became law and dealt with
elimination of the requirement for a local district to permit a
school bus driver. A section of Idaho code, 33-1508, did not get
changed at that time. This bill makes that correction and again
puts Idaho code, in this area, in concurrence.
