  2    RELATING TO SCHOLARSHIPS; AMENDING CHAPTER 43, TITLE 33, IDAHO  CODE,  BY  THE
  3        ADDITION  OF  NEW  SECTIONS  33-4316,  33-4317, 33-4318, 33-4319, 33-4320,
  4        33-4321, 33-4322, 33-4323, 33-4324, 33-4325 AND 33-4326,  IDAHO  CODE,  TO
  5        PROVIDE A SHORT TITLE, TO PROVIDE PURPOSES OF THE ACT, TO PROVIDE LEGISLA-
  6        TIVE  INTENT,  TO  PROVIDE  DEFINITIONS,  TO  PROVIDE ELIGIBILITY, MAXIMUM
  7        AMOUNTS AND CONDITIONS FOR AN IDAHO HEALTH SCIENCES SCHOLARSHIP,  TO  PRO-
  8        VIDE  FOR  THE MAXIMUM NUMBER OF SCHOLARSHIPS IN ANY GIVEN FISCAL YEAR, TO
  9        PROVIDE FOR INELIGIBILITY UPON DISCONTINUED ATTENDANCE OR CHANGE OF MAJOR,
 10        TO PROHIBIT DISCRIMINATION IN AWARDING SCHOLARSHIPS, TO PROVIDE DUTIES  OF
 11        ELIGIBLE  POSTSECONDARY INSTITUTIONS, TO DESIGNATE THE STATE BOARD OF EDU-
 12        CATION AND THE BOARD OF REGENTS OF THE UNIVERSITY OF IDAHO AS THE ADMINIS-
 13        TRATIVE AGENCY AND TO PROVIDE DUTIES OF THE BOARD.
                                                                        
 14    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 15        SECTION 1.  That Chapter 43, Title 33, Idaho Code, be,  and  the  same  is
 16    hereby  amended by the addition thereto of a NEW SECTION, to be known and des-
 17    ignated as Section 33-4316, Idaho Code, and to read as follows:
                                                                        
 18        33-4316.  SHORT TITLE. This act shall be known and  cited  as  the  "Idaho
 19    Health Sciences Scholarship Act of 2005." The scholarship program provided for
 20    in  this  act  shall be known and cited as the "Idaho Health Sciences Scholar-
 21    ship."
                                                                        
 22        SECTION 2.  That Chapter 43, Title 33, Idaho Code, be,  and  the  same  is
 23    hereby  amended by the addition thereto of a NEW SECTION, to be known and des-
 24    ignated as Section 33-4317, Idaho Code, and to read as follows:
                                                                        
 25        33-4317.  PURPOSES. The purpose of this act is to:
 26        (1)  Establish a merit-based state scholarship for eligible  students  who
 27    are  pursuing  a  postsecondary degree, certificate or diploma in human health
 28    sciences at eligible postsecondary institutions;
 29        (2)  Provide eligible postsecondary institutions a  tool  to  improve  the
 30    recruitment  and retention of eligible Idaho students who are pursuing a post-
 31    secondary degree, certificate or diploma in human health sciences; and
 32        (3)  Encourage scholarship recipients to pursue careers  in  human  health
 33    professions in Idaho upon graduation.
                                                                        
 34        SECTION  3.  That  Chapter  43,  Title 33, Idaho Code, be, and the same is
 35    hereby amended by the addition thereto of a NEW SECTION, to be known and  des-
 36    ignated as Section 33-4318, Idaho Code, and to read as follows:
                                                                        
 37        33-4318.  LEGISLATIVE  INTENT.  It  is  the  intent  of the legislature in
 38    enacting this act, sections 33-4316 through  33-4326,  Idaho  Code,  that  the
 39    Idaho  health  sciences scholarship shall be funded, subject to appropriation,

  1    from the Idaho millennium income fund.
                                                                        
  2        SECTION 4.  That Chapter 43, Title 33, Idaho Code, be,  and  the  same  is
  3    hereby  amended by the addition thereto of a NEW SECTION, to be known and des-
  4    ignated as Section 33-4319, Idaho Code, and to read as follows:
                                                                        
  5        33-4319.  DEFINITIONS. As used in this act:
  6        (1)  "Cumulative grade point average"  means  the  cumulative  average  of
  7    grade  points  earned by a student for all postsecondary courses taken, calcu-
  8    lated on a four (4.0) point scale where a  grade  of  "A"  equals  four  (4.0)
  9    points,  a  grade  of "B" equals three (3.0) points, a grade of "C" equals two
 10    (2.0) points, a grade of "D" equals one (1.0) point and a grade of "F"  equals
 11    zero (0.0) points.
 12        (2)  "Educational  costs" means costs for student fees or tuition, related
 13    costs for room, board, books and commuting, and such other expenses reasonably
 14    related to attendance at an  eligible  postsecondary  institution  as  may  be
 15    approved  by the state board of education and the board of regents of the uni-
 16    versity of Idaho.
 17        (3)  "Educational year" means the period from July 1  of  a  year  through
 18    June 30 of the succeeding year.
 19        (4)  "Eligible  major"  means  the  basic  curriculum of an undergraduate,
 20    associate, or professional-technical human health sciences  education  program
 21    at an eligible postsecondary institution as defined under rules established by
 22    the  state  board  of  education and the board of regents of the university of
 23    Idaho.
 24        (5)  "Eligible postsecondary institution"  means  a  public  postsecondary
 25    educational  institution  in  the state of Idaho governed or supervised by the
 26    state board of education, the board of regents of the university of  Idaho,  a
 27    board  of  trustees  of a community college established pursuant to the provi-
 28    sions of section 33-2106, Idaho Code, or the  state  board  for  professional-
 29    technical education.
 30        (6)  "Eligible  student"  means  a  student who meets all of the following
 31    requirements:
 32        (a)  Is a resident student as defined  in  section  33-2110B  or  33-3717,
 33        Idaho Code;
 34        (b)  Is  matriculated on a full-time basis in an eligible major at an eli-
 35        gible postsecondary institution;
 36        (c)  Is either: (i)  an undergraduate student in his junior year of  study
 37        or  has  otherwise  completed  a  minimum of forty-eight (48) credit hours
 38        toward a human health sciences education program; or (ii)  a student in an
 39        academic associate degree program who has completed the first semester  of
 40        his  human  health  sciences  degree  program;  or  (iii)  a professional-
 41        technical student who has completed the first semester of his human health
 42        sciences degree program; and
 43        (d)  Has achieved and maintained at least a three (3.0)  point  cumulative
 44        grade point average at an eligible postsecondary institution.
 45        (7)  "Full-time  basis"  means  enrolling  in twelve (12) credit hours per
 46    semester, or equivalent time period, at an eligible postsecondary institution,
 47    and assessed the student fees and tuition normally charged for full-time study
 48    by that institution.
                                                                        
 49        SECTION 5.  That Chapter 43, Title 33, Idaho Code, be,  and  the  same  is
 50    hereby  amended by the addition thereto of a NEW SECTION, to be known and des-
 51    ignated as Section 33-4320, Idaho Code, and to read as follows:

  1        33-4320.  ELIGIBILITY -- MAXIMUM AMOUNTS -- CONDITIONS. (1)  The  scholar-
  2    ship for eligible students is as follows:
  3        (a)  The  scholarship  payment to an eligible student per educational year
  4        shall be an amount, not in excess of  one  thousand  two  hundred  dollars
  5        ($1,200),  determined  annually  by  the  state board of education and the
  6        board of regents of the university of Idaho. Provided  however,  that  the
  7        state  board  of  education  and the board of regents of the university of
  8        Idaho may increase the maximum scholarship amount per educational year  by
  9        a  percentage  not  in  excess  of  the  average percentage of student fee
 10        increases at the eligible postsecondary institutions.
 11        (b)  Scholarship payments shall  be  dispersed  once  per  academic  term,
 12        semester, quarter or equivalent time period.
 13        (c)  Notwithstanding  the  provisions  of  section 33-4319(7), Idaho Code,
 14        students who are enrolled in less than  twelve  (12)  credit  hours  as  a
 15        result  of  their  participation  in  a  clinical practicum for which they
 16        receive zero (0) credit hours and which is required as  a  part  of  their
 17        human health sciences program curriculum shall be eligible for this schol-
 18        arship. Provided however, that the scholarship payment shall be reduced in
 19        proportion  to the number of credit hours in which the student is actually
 20        enrolled.
 21        (2)  Scholarships are renewable when the following requirements are met:
 22        (a)  An eligible student engaged in a baccalaureate program shall be  eli-
 23        gible  for this scholarship for a cumulative period not to exceed four (4)
 24        academic semesters.
 25        (b)  An eligible student engaged in an associate degree program  shall  be
 26        eligible  for this scholarship for a cumulative period not to exceed three
 27        (3) academic semesters.
 28        (c)  An eligible student engaged in a professional-technical program shall
 29        be eligible for this scholarship for a cumulative  period  not  to  exceed
 30        four (4) academic semesters.
 31        (3)  Undergraduate  and  professional-technical  students  are eligible to
 32    receive this scholarship from one (1) eligible postsecondary institution. Once
 33    an undergraduate or professional-technical student accepts this scholarship at
 34    an eligible postsecondary institution, he  shall  not  be  eligible  for  this
 35    scholarship at another eligible postsecondary institution.
 36        (4)  Students  who  transfer  from  one of Idaho's community colleges upon
 37    completion of an associate degree program to an eligible postsecondary  insti-
 38    tution  for  the purpose of enrolling in a baccalaureate human health sciences
 39    program are eligible for this scholarship at the discretion of the participat-
 40    ing institutions.
 41        (5)  Scholarship recipients who fail to comply with the provisions of this
 42    act shall be forever barred from future consideration for this scholarship.
                                                                        
 43        SECTION 6.  That Chapter 43, Title 33, Idaho Code, be,  and  the  same  is
 44    hereby  amended by the addition thereto of a NEW SECTION, to be known and des-
 45    ignated as Section 33-4321, Idaho Code, and to read as follows:
                                                                        
 46        33-4321.  MAXIMUM NUMBER OF SCHOLARSHIPS. The maximum number  of  scholar-
 47    ships  in  any given fiscal year shall be the amount of the fiscal year appro-
 48    priation for this scholarship divided by the amount of the scholarship payment
 49    as determined annually by the state board of education.
                                                                        
 50        SECTION 7.  That Chapter 43, Title 33, Idaho Code, be,  and  the  same  is
 51    hereby  amended by the addition thereto of a NEW SECTION, to be known and des-
 52    ignated as Section 33-4322, Idaho Code, and to read as follows:

  1        33-4322.  INELIGIBILITY UPON DISCONTINUED ATTENDANCE OR CHANGE  OF  MAJOR.
  2    If  a student discontinues attendance or changes to an ineligible major before
  3    the end of any semester or equivalent time period covered by this  scholarship
  4    after  receiving  payment  under this act, the student shall be ineligible for
  5    this scholarship for the next semester or equivalent time period in which  the
  6    student matriculates and would otherwise be eligible.
                                                                        
  7        SECTION  8.  That  Chapter  43,  Title 33, Idaho Code, be, and the same is
  8    hereby amended by the addition thereto of a NEW SECTION, to be known and  des-
  9    ignated as Section 33-4323, Idaho Code, and to read as follows:
                                                                        
 10        33-4323.  DISCRIMINATION  PROHIBITED. The scholarships shall be awarded to
 11    eligible students without regard to any student's race, creed, color,  gender,
 12    national origin, ancestry or age.
                                                                        
 13        SECTION  9.  That  Chapter  43,  Title 33, Idaho Code, be, and the same is
 14    hereby amended by the addition thereto of a NEW SECTION, to be known and  des-
 15    ignated as Section 33-4324, Idaho Code, and to read as follows:
                                                                        
 16        33-4324.  DUTIES  OF  ELIGIBLE  POSTSECONDARY  INSTITUTIONS. (1)  Eligible
 17    postsecondary institutions shall be responsible for:
 18        (a)  Selecting recipients of scholarships; and
 19        (b)  Determining procedures for payment of awards.
 20        (2)  Eligible postsecondary institutions which accept students  under  the
 21    provisions  of this act shall be required to comply with procedures for certi-
 22    fication of matriculation and declaration  of  major  of  recipients  of  such
 23    scholarships,  and  shall  be  required,  under rules established by the state
 24    board of education, to notify the state board of education of the  termination
 25    of attendance or change of major outside of an eligible major by recipients of
 26    such scholarships.
 27        (3)  All  eligible postsecondary institutions shall report annually to the
 28    state board of education and the board of regents of the university  of  Idaho
 29    the number of students for each term receiving a scholarship award.
                                                                        
 30        SECTION  10.  That  Chapter  43, Title 33, Idaho Code, be, and the same is
 31    hereby amended by the addition thereto of a NEW SECTION, to be known and  des-
 32    ignated as Section 33-4325, Idaho Code, and to read as follows:
                                                                        
 33        33-4325.  STATE  BOARD  OF EDUCATION AND BOARD OF REGENTS OF UNIVERSITY OF
 34    IDAHO AS ADMINISTRATIVE AGENCY. The state board of education and the board  of
 35    regents  of the university of Idaho is hereby designated as the administrative
 36    agency for the scholarship created by this act.
                                                                        
 37        SECTION 11.  That Chapter 43, Title 33, Idaho Code, be, and  the  same  is
 38    hereby  amended by the addition thereto of a NEW SECTION, to be known and des-
 39    ignated as Section 33-4326, Idaho Code, and to read as follows:
                                                                        
 40        33-4326.  DUTIES OF BOARD. The state board of education and the  board  of
 41    regents of the university of Idaho shall be responsible for:
 42        (1)  Supervision of the issuance of public information concerning the pro-
 43    visions of this act.
 44        (2)  Adoption of rules necessary to implement this program.
 45        (3)  Maintenance  of fiscal controls and fund accounting procedures as may
 46    be necessary to assure proper disbursement of funds.
 47        (4)  Submission of an annual report to the legislative services office and

  1    the division of financial management not later than November 1 of each year.
  2        (5)  Establishment of a reasonable and fair  appeal  procedure  for  those
  3    students  and  institutions who may have been adversely affected by a decision
  4    made under the procedures of this act and rules promulgated pursuant thereto.
  5        (6)  Holding a public hearing, prior to the adoption  of  rules,  for  the
  6    purpose  of  providing  interested  parties with the opportunity of discussing
  7    such rules.
  8        (7)  Acceptance of funds from public and private sources, and  such  funds
  9    may  be expended pursuant to appropriation to the state board of education and
 10    the board of regents of the university of  Idaho  for  expenditure  consistent
 11    with the purposes of this act.

Statement of Purpose / Fiscal Impact



                       STATEMENT OF PURPOSE

This legislation would create a new scholarship for
undergraduate, associate and professional-technical students in
human health sciences programs.  The purpose of the scholarship
would be to increase the number of human health sciences students
and to encourage them to pursue their careers in Idaho upon
graduation.  The scholarship would only be available to full-time
students who are Idaho residents and demonstrate academic merit. 
The scholarship could not be used at any public postsecondary
educational institution in Idaho.  The initial amount of the
scholarship would be a maximum of $1,200 per academic year, but
an escalator clause would enable the scholarship to keep up with
increases in student fees.  The State Board of Education is given
broad rule-making authority to implement this legislation.


                            FISCAL NOTE  
       
There is no fiscal impact to the General Fund.  The sole
funding source for this scholarship would be form the Millennium
