  1                                        AN ACT
  2    RELATING TO THE APPROPRIATION FOR THE PUBLIC SCHOOLS DIVISION  OF  FACILITIES;
  3        APPROPRIATING FUNDS TO THE EDUCATIONAL SUPPORT PROGRAM/DIVISION OF FACILI-
  4        TIES FOR FISCAL YEAR 2006; TRANSFERRING AND APPROPRIATING CERTAIN FUNDS TO
  5        THE BOND LEVY EQUALIZATION FUND; AND DIRECTING THE DISTRIBUTION OF CERTAIN
  6        FUNDS PURSUANT TO IDAHO CODE.
                                                                        
  7    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  8        SECTION  1.  There  is  hereby  appropriated  to  the  Educational Support
  9    Program/Division of Facilities, pursuant to law and  the  provisions  of  this
 10    act,  the  following amount to be expended from the listed fund for the period
 11    July 1, 2005, through June 30, 2006:
 12    FROM:
 13    School District Building Account                                   $13,450,000
                                                                        
 14        SECTION 2.  The provisions of Section 33-905, Idaho Code, notwithstanding,
 15    of the moneys appropriated in Section 1 of this act, the amount  necessary  to
 16    fund  the  provisions of Section 33-906, Idaho Code, is hereby transferred and
 17    appropriated from the School District Building Account to the Bond Levy Equal-
 18    ization Fund. The Bond Levy Equalization Fund is hereby continuously appropri-
 19    ated for the period July 1, 2005, through June 30, 2006, pursuant to the fund-
 20    ing requirements of Section 33-906, Idaho Code.
                                                                        
 21        SECTION 3.  Any moneys appropriated in Section 1 of this act that are  not
 22    utilized  to  satisfy the provisions of Section 2 of this act, up to a maximum
 23    of $8,922,500, shall be distributed pursuant  to  the  provisions  of  Section
 24    33-905, Idaho Code.

This is the Fiscal Year 2006 appropriation for the Division of Facilities portion of the Public Schools budget. The pieces of the Public Schools budget that are part of this division's appropriation, all of which are funded with State Lottery revenues, include: 1.) Funding for the Bond Levy Equalization program; and 2.) the regular distribution to Idaho school districts of all net remaining lottery proceeds.
