2 PROPOSING AN AMENDMENT TO SECTION 2, ARTICLE IX, OF THE CONSTITUTION OF THE
3 STATE OF IDAHO, RELATING TO THE STATE BOARD OF EDUCATION, TO PROVIDE THAT
4 THE RESPONSIBILITY OF THE STATE BOARD OF EDUCATION SHALL BE LIMITED TO
5 SUPERVISION OF THE PUBLIC SCHOOL SYSTEM AND TO PROVIDE A SEPARATE BOARD OF
6 REGENTS TO SUPERVISE THE PUBLIC INSTITUTIONS OF POSTSECONDARY EDUCATION IN
7 THE STATE AND PERFORM SUCH OTHER FUNCTIONS AS PRESCRIBED BY LAW; STATING
8 THE QUESTION TO BE SUBMITTED TO THE ELECTORATE; DIRECTING THE LEGISLATIVE
9 COUNCIL TO PREPARE THE STATEMENTS REQUIRED BY LAW; AND DIRECTING THE SEC-
10 RETARY OF STATE TO PUBLISH THE AMENDMENT AND ARGUMENTS AS REQUIRED BY LAW.
11 Be It Resolved by the Legislature of the State of Idaho:
12 SECTION 1. That Section 2, Article IX, of the Constitution of the State
13 of Idaho be amended to read as follows:
14 SECTION 2. BOARD OF EDUCATION -- BOARD OF REGENTS. (1) The
15 general supervision of the state educational institutions and public
16 school system of the state of Idaho, shall be vested in a state board
17 of education, the membership, powers and duties of which shall be
18 prescribed by law. The state superintendent of public instruction
19 shall be ex officio member of said board.
20 (2) The general supervision of the public institutions of post-
21 secondary education in the state, and such other functions as pre-
22 scribed by law, shall be vested in a state board of regents, the mem-
23 bership, powers and duties of which shall be prescribed by law.
24 SECTION 2. The question to be submitted to the electors of the State of
25 Idaho at the next general election shall be as follows:
26 "Shall Section 2, Article IX, of the Constitution of the State of Idaho be
27 amended to limit the responsibility of the State Board of Education to super-
28 vision of the public school system, and to provide a separate board of regents
29 to supervise the public institutions of postsecondary education in the state
30 and perform such other functions as prescribed by law?".
31 SECTION 3. The Legislative Council is directed to prepare the statements
32 required by Section 67-453, Idaho Code, and file the same.
33 SECTION 4. The Secretary of State is hereby directed to publish this pro-
34 posed constitutional amendment and arguments as required by law.
STATEMENT OF PURPOSE
The purpose of this legislation is allow the People of the State of Idaho to decide if
they want to amend Section 2, Article IX, of the Constitution of the State of Idaho,
to provide that the responsibility of the State Board of Education shall be limited to
supervision of the public school system and to provide a separate Board of Regents
to supervise the public institutions of post-secondary education and to perform such
other functions as prescribed by law.
Based on an estimate from the Secretary of State's Office, the cost for placing this
Resolution on the ballot wold be approximately $45,000 to $50,000.
