  1                                        AN ACT
  2    RELATING TO THE SCIENCE AND TECHNOLOGY ADVISORY COUNCIL; AMENDING CHAPTER  47,
  3        TITLE  67,  IDAHO  CODE,  BY  THE ADDITION OF A NEW SECTION 67-4726, IDAHO
  4        CODE, TO CREATE A SCIENCE AND TECHNOLOGY ADVISORY COUNCIL, TO PROVIDE MEM-
  5        BERSHIP OF THE COUNCIL AND TO PROVIDE DUTIES OF THE COUNCIL.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION 1.  That Chapter 47, Title 67, Idaho Code, be,  and  the  same  is
  8    hereby  amended by the addition thereto of a NEW SECTION, to be known and des-
  9    ignated as Section 67-4726, Idaho Code, and to read as follows:
                                                                        
 10        67-4726.  SCIENCE AND TECHNOLOGY ADVISORY COUNCIL -- APPOINTMENT  OF  MEM-
 11    BERS  -- QUALIFICATIONS. (1) The state of Idaho recognizes that the health and
 12    expansion of Idaho's future economy will depend upon taking full advantage  of
 13    research   and  technology,  and  that  Idaho  has  impressive  resources  for
 14    technology-based growth, internationally recognized university  research  pro-
 15    grams,  globally competitive technology companies and the Idaho national labo-
 16    ratory.
 17        The science and technology advisory council is hereby  created  to  advise
 18    the department of commerce and labor, the state board of education, state col-
 19    leges  and  universities,  and  other state, local, federal and private sector
 20    agencies and organizations on science and technology interests and potentials;
 21    to support the development and publishing of information on the condition  and
 22    importance  of  science  and technology to the state's economy; to assist with
 23    the development and implementation of a state strategic plan for  science  and
 24    technology;  and  to  assist with the coordination of local, state and federal
 25    interests to increase the positive economic impact of the state's science  and
 26    technology resources.
 27        (2)  The  council  shall  be appointed by and serve at the pleasure of the
 28    governor. Membership of the council shall  include  individuals  knowledgeable
 29    and  experienced  in  science and technology issues. The council shall include
 30    representatives from the private sector who have expertise in the transfer and
 31    commercialization of science and  technology,  and  representatives  from  the
 32    department  of commerce and labor, the office of the state board of education,
 33    and the office of the governor. The governor shall designate a  chairman  from
 34    the  council's  membership and the council shall designate such other officers
 35    from its membership as it deems necessary. The chairman  and  council  members
 36    from  the  department  of commerce and labor, the office of the state board of
 37    education, and the office of the governor shall serve as the executive commit-
 38    tee of the council. The council shall be staffed and supported by the  depart-
 39    ment of commerce and labor. Members of the council who are not state employees
 40    shall  be compensated for actual and necessary expenses as provided by section
 41    59-509(b), Idaho Code.

     In the past, the Science and Technology Advisory Council
existed by Executive Order of the Governor.  This legislation
would create a Science and Technology Advisory Council in state
statute and define its governing structure. 

     The purpose of the Council will be to advise the Department
of Commerce and Labor, the State Board of Education, State
Colleges and Universities, and other state, local, federal and
private sector agencies and organizations on science and
technology interests; to support the development and publishing
of information on the condition and importance of science and
technology to the state's economy; to assist with the development
and implementation of a state strategic plan for science and
technology; and to assist with the coordination of local, state,
and federal interests to increase the positive economic impact of
the state's science and technology resources.




                          FISCAL NOTE

     This legislation will have no negative impact on the state
General Fund for reimbursement of actual and necessary expenses
for attendance at Council meetings by members of the Council who
are not state employees. 

     The Department of Commerce and Labor will provide
administrative support to the Council without the need for
additional funding.
