POLITICAL CANDIDATES - Amends existing law to provide that the political
treasurer for a candidate who was defeated in the primary election and
whose post-primary report shows an unexpended balance of contributions or a
campaign debt, shall continue to file annual reports until there is no
unexpended balance of contributions or no campaign expenditure deficit.

2 RELATING TO DISPOSITION OF UNEXPENDED BALANCES BY CANDIDATES; AMENDING SECTION
3 67-6608, IDAHO CODE, TO PROVIDE THAT THE POLITICAL TREASURER FOR A CANDI-
4 DATE WHO WAS DEFEATED IN THE PRIMARY ELECTION AND WHOSE POST-PRIMARY
5 REPORT SHOWS AN UNEXPENDED BALANCE OF CONTRIBUTIONS OR A CAMPAIGN DEBT,
6 SHALL CONTINUE TO FILE ANNUAL REPORTS UNTIL THERE IS NO UNEXPENDED BALANCE
7 OF CONTRIBUTIONS OR NO CAMPAIGN EXPENDITURE DEFICIT; AND DECLARING AN
8 EMERGENCY.
9 Be It Enacted by the Legislature of the State of Idaho:
10 SECTION 1. That Section 67-6608, Idaho Code, be, and the same is hereby
11 amended to read as follows:
12 67-6608. DISPOSITION OF UNEXPENDED BALANCES. (a) If a statement filed
13 under paragraph (3) of subsection (a) of section 67-6607, Idaho Code, pertain-
14 ing to post-general election reports or under paragraph (6) of subsection (a)
15 of section 67-6607, Idaho Code, shows an unexpended balance of contributions
16 or an expenditure deficit, the political treasurer for the candidate for
17 nonstatewide office or political committee or measure shall continue to file
18 annual reports on January 31, to cover the period since the end of the last
19 report period, to and including the last day of the month preceding the month
20 in which the report is filed. If a statement filed under paragraph (6) of sub-
21 section (a) of section 67-6607, Idaho Code, shows an unexpended balance of
22 contributions or an expenditure deficit, the political treasurer for the can-
23 didate for statewide office shall continue to file semiannual reports on Janu-
24 ary 31 and July 31, to cover the period since the end of the last report
25 period, to and including the last day of the month preceding the month in
26 which the report is filed. Such reports shall be filed until the account shows
27 no unexpended balance of contributions or expenditure deficit.
28 (b) If a candidate wins nomination, supplemental statements under subsec-
29 tion (a) of this section need not be filed with respect to the nomination cam-
30 paign by the political treasurer of a political committee supporting the can-
31 didate or by the political treasurer for such candidate, if such political
32 committee continues to function in support of such candidate in the campaign
33 for the general or special election.
34 (c) A political committee which is organized after an election shall file
35 reports required by subsection (a) of this section.
36 (d) The political treasurer for a candidate who was defeated in the pri-
37 mary election and whose post-primary report shows an unexpended balance of
38 contributions or a campaign debt, shall continue to file annual reports until
39 there is no unexpended balance of contributions or no campaign expenditure
40 deficit.
41 SECTION 2. An emergency existing therefor, which emergency is hereby
42 declared to exist, this act shall be in full force and effect on and after its

1 passage and approval.
STATEMENT OF PURPOSE
RS 15519
The purpose of this legislation is to amend the Sunshine Law to
provide that candidates who lose the primary must file campaign
disclosure reports until they reach a zero balance. Such
reporting requirement is similar to those who lost in the general
election. This bill is needed to track that contribution limits
are followed for the primary election.
