provide any grape grower or wine producer the alternative to opt out of the
applications of all provisions of Chapter 36, Title 54, Idaho Code,

1 AN ACT
2 RELATING TO THE IDAHO GRAPE GROWERS AND WINE PRODUCERS COMMISSION; AMENDING
3 CHAPTER 36, TITLE 54, IDAHO CODE, BY THE ADDITION OF A NEW SECTION
4 54-3611, IDAHO CODE, TO PROVIDE ANY GROWER OR PRODUCER THE ALTERNATIVE TO
5 OPT OUT OF APPLICATION OF ALL PROVISIONS OF CHAPTER 36, TITLE 54, IDAHO
6 CODE.
7 Be It Enacted by the Legislature of the State of Idaho:
8 SECTION 1. That Chapter 36, Title 54, Idaho Code, be, and the same is
9 hereby amended by the addition thereto of a NEW SECTION, to be known and des-
10 ignated as Section 54-3611, Idaho Code, and to read as follows:
11 54-3611. OPT OUT ALTERNATIVE. (1) Each and every year, any grower or
12 producer may, at his election, opt out of application of all provisions of
13 this chapter, including assessment provisions. In order to opt out of applica-
14 tion of the provisions of this chapter, a grower or producer shall comply with
15 the following requirements:
16 (a) On an annual basis, no later than June 30 of each year, submit a let-
17 ter to the Idaho grape growers and wine producers commission, stating
18 intent to opt out of application of the provisions of the chapter for the
19 upcoming fiscal year; and
20 (b) The letter shall include the grower's or producer's name and address.
21 (2) The Idaho grape growers and wine producers commission shall post the
22 address of the commission on its official website. The commission shall also
23 set forth its mailing address by rule.
STATEMENT OF PURPOSE
RS 15585
This legislation allows growers or wineries to opt out of
participation in the activities of the Grape Growers and Wine
Producers Commission.
FISCAL NOTE
Fiscal impact to the Commission would be less than $1,000
annually.
