  1                                        AN ACT
  2    RELATING TO THE DIVISION OF VETERANS SERVICES; AMENDING SECTION 65-201,  IDAHO
  3        CODE,  TO  TRANSFER  ALL  RIGHTS,  TITLE AND INTEREST IN REAL AND PERSONAL
  4        PROPERTY HELD BY THE DEPARTMENT OF HEALTH AND WELFARE FOR THE  PURPOSE  OF
  5        PROVIDING  SERVICES  TO  VETERANS  TO THE DIVISION OF VETERANS SERVICES IN
  6        FURTHER COMPLIANCE WITH CHAPTER 59, LAWS OF 2000; AND DECLARING  AN  EMER-
  7        GENCY.
                                                                        
  8    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  9        SECTION  1.  That  Section  65-201, Idaho Code, be, and the same is hereby
 10    amended to read as follows:
                                                                        
 11        65-201.  DIVISION OF  VETERANS  SERVICES  --  CREATION  OF  COMMISSION  --
 12    APPOINTMENT OF MEMBERS -- DISCONTINUANCE OF COMMISSION -- RECEIPT OF PROPERTY.
 13    (1)  There  is hereby established in the department of self-governing agencies
 14    the division of veterans services. The division shall be headed by an adminis-
 15    trator who shall be appointed by the governor from a nomination list of eligi-
 16    ble candidates for administrator submitted by the veterans affairs commission.
 17    The administrator may be removed from office by the  governor  only  with  the
 18    consent of the veterans affairs commission.
 19        (2)  There  is  hereby  created  an advisory commission to be known as the
 20    Idaho veterans affairs commission to consist of five (5) persons, all of  whom
 21    shall  be  appointed  by  the  governor of the state of Idaho. Said appointees
 22    shall have had active service in any war or conflict officially engaged in  by
 23    the  government  of  the United States and have been honorably discharged from
 24    such service. No more than two (2) of said commission shall  be  residents  of
 25    the  same  judicial  district  of the state of Idaho. Upon the expiration of a
 26    member's term, the subsequent appointment shall be made by  the  governor  and
 27    shall  be for a term of three (3) years. Such subsequent terms shall expire on
 28    the third Monday in January of the appropriate year. The governor  shall  have
 29    power to fill any and all vacancies occurring in said commission. The governor
 30    shall  have the further full power to discontinue said commission by proclama-
 31    tion whenever the governor  determines  that  the  government  of  the  United
 32    States, or the state of Idaho, shall have made adequate provision for the care
 33    and  assistance  of  honorably  discharged and destitute veterans of the armed
 34    forces.
 35        (3)  All rights, title and interest in property, real and  personal,  held
 36    by  the  department of health and welfare for use in exercising the powers and
 37    duties transferred to the division of veterans services by chapter 59, laws of
 38    2000, are hereby transferred to and vested in the division  of  veterans  ser-
 39    vices.
                                                                        
 40        SECTION  2.  An  emergency  existing  therefor,  which emergency is hereby
 41    declared to exist, this act shall be in full force and effect on and after its
 42    passage and approval.

                      STATEMENT OF PURPOSE
                                
                            RS 15446

This bill corrects an oversight in the original legislation
transferring the powers and duties concerning services to
veterans from the Department of Health and Welfare to the
Division of Veterans Services.  The amended language allows the
administrator of the Division of Veterans Services to exercise
control over such property.

There is no impact to the General Fund.
