1 AN ACT
2 RELATING TO THE IDAHO MINT COMMISSION; AMENDING SECTION 22-3811, IDAHO CODE,
3 TO REVISE PROVISIONS RELATING TO THE DISBURSEMENT OF MONEYS FROM THE
4 ACCOUNTS OF THE IDAHO MINT COMMISSION AND TO MAKE TECHNICAL CORRECTIONS.
5 Be It Enacted by the Legislature of the State of Idaho:
6 SECTION 1. That Section 22-3811, Idaho Code, be, and the same is hereby
7 amended to read as follows:
8 22-3811. DISPOSITION OF RECEIPTS AND USE OF MONEYS COLLECTED. (1) As soon
9 as possible after receipt, all moneys received by the commission from the
10 assessment levied under section 22-3806, of this act Idaho Code, and all other
11 moneys received by the commission shall be deposited in one (1) or more sepa-
12 rate accounts in the name of the commission in one (1) or more banks or trust
13 companies approved under chapter 27, title 67, Idaho Code, as state deposito-
14 ries. The commission shall designate such accounts at such banks or trust com-
15 panies.
16 (2) (a) No moneys shall be withdrawn from or paid out of such accounts
17 except upon order of the commission, and upon checks or other orders upon
18 such accounts signed by such member of the commission as the commission
19 designates. and countersigned by such other member, officer or employee of
20 the commission as the commission designates. A receipt, voucher or other
21 written record, showing clearly the nature and items covered by each check
22 or other order, shall be kept.
23 (b) All moneys referred to in subsection (1) of this section shall be
24 used by the commission only for the payment of expenses of the commission
25 in carrying out the powers conferred on the commission.
26 (c) The commission may require any commission member or agent or employee
27 appointed by the commission, to give a bond payable to the commission in
28 the amount, and with the security and containing the terms and conditions
29 the commission prescribes. The cost of such bond is an administrative cost
30 under this act chapter.
31 (3) The right is reserved to the state of Idaho to audit all funds of the
32 commission at any time.
STATEMENT OF PURPOSE
RS 15757
Legislative auditors have indicated that it is no longer
necessary for small commodity commissions to require two (2)
signatures on checking accounts. The commissions require action
by the commission to withdraw or pay out of accounts. These
accounts are audited by legislative auditors. In some instances
members of the commissions are some distance apart and it is
difficult to obtain two (2) signatures.
FISCAL IMPACT
There is no impact to the general fund.
