  1                                        AN ACT
  2    RELATING TO RULES OF THE ROAD; AMENDING CHAPTER 6, TITLE 49,  IDAHO  CODE,  BY
  3        THE  ADDITION OF A NEW SECTION 49-624, IDAHO CODE, TO PROVIDE FOR THE DUTY
  4        OF A DRIVER OF A MOTOR VEHICLE UPON APPROACHING A STATIONARY POLICE  VEHI-
  5        CLE OR AN AUTHORIZED EMERGENCY VEHICLE DISPLAYING FLASHING LIGHTS.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION  1.  That  Chapter  6,  Title  49, Idaho Code, be, and the same is
  8    hereby amended by the addition thereto of a NEW SECTION, to be known and  des-
  9    ignated as Section 49-624, Idaho Code, and to read as follows:
                                                                        
 10        49-624.  DRIVER  DUTY  UPON  APPROACHING A STATIONARY POLICE VEHICLE OR AN
 11    AUTHORIZED EMERGENCY VEHICLE DISPLAYING FLASHING LIGHTS. The driver of a motor
 12    vehicle, upon approaching a  stationary  police  vehicle  displaying  flashing
 13    lights or an authorized emergency vehicle displaying flashing lights shall:
 14        (1)  If  the  driver  is traveling on a highway with two (2) or more lanes
 15    carrying traffic in the same direction, immediately reduce the  speed  of  his
 16    vehicle,  proceed  with due caution, or change lanes as soon as it is possible
 17    to do so in a manner that is reasonable and prudent under the conditions  then
 18    existing, with regard to actual and potential hazards.
 19        (2)  If  the  driver  is traveling on a highway with one (1) lane for each
 20    direction of travel, immediately reduce the speed of his vehicle, and maintain
 21    a safe speed for the road, weather and  traffic  conditions  until  completely
 22    past the stationary police vehicle or authorized emergency vehicle.

                       STATEMENT OF PURPOSE

                             RS 15490

This legislation applies when drivers are approaching a
stationary police vehicle displaying flashing lights.  They will
reduce their speed for safety purposes, and if on a highway with
two or more lanes going the same direction, they will move into
another lane of traffic.  Moving into another lane of traffic is
necessary only if it is safe to do so.
