  2    RELATING TO THE MILITARY VETERAN MOTORCYCLE LICENSE  PLATE;  AMENDING  SECTION
  3        49-418D,  IDAHO  CODE, TO REVISE THE DATE OF AVAILABILITY OF THE PLATE AND
  4        TO REVISE PROVISIONS FOR APPROVAL OF THE PLATE DESIGN AND  NUMBERING  SYS-
  5        TEM; DECLARING AN EMERGENCY AND PROVIDING RETROACTIVE APPLICATION.
                                                                        
  6    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  7        SECTION  1.  That  Section 49-418D, Idaho Code, be, and the same is hereby
  8    amended to read as follows:
                                                                        
  9        49-418D.  MILITARY VETERAN MOTORCYCLE LICENSE PLATE. (1) On and after Jan-
 10    uary 1, 20056, any person who is the owner of a  motorcycle  registered  under
 11    the  provisions  of section 49-402, Idaho Code, may apply for and upon depart-
 12    ment approval receive a military veteran motorcycle license plate in lieu of a
 13    regular motorcycle license plate.
 14        (2)  Proof of being a current or former member of the United States  armed
 15    forces  must  be  furnished to the department before a military veteran motor-
 16    cycle plate will be issued. Acceptable proof shall be a copy of form DD214  or
 17    an equivalent document or statement from the department of veterans affairs.
 18        (3)  In  addition  to  the  annual  registration  fee  required in section
 19    49-402(3), Idaho Code, the applicant shall be charged  a  fee  of  twenty-five
 20    dollars  ($25.00)  for  the  initial  issuance of a plate, and fifteen dollars
 21    ($15.00) upon each succeeding annual registration. Ten dollars ($10.00) of the
 22    initial program fee and ten dollars ($10.00) of the annual program  fee  shall
 23    be  deposited  in the state highway account and shall be used to fund the cost
 24    of administration of this special motorcycle license  plate  program.  Fifteen
 25    dollars  ($15.00)  of  the initial program fee and five dollars ($5.00) of the
 26    annual program fee shall be deposited to  the  veterans  cemetery  maintenance
 27    fund  created  in  section 65-107, Idaho Code, to operate and maintain a state
 28    veterans cemetery.
 29        (4)  Whenever title or interest in a motorcycle registered under the  pro-
 30    visions of this section is transferred or assigned, the owner may transfer the
 31    special  plate  to  another  motorcycle  upon payment of the required transfer
 32    fees. The owner may only display the plate on another motorcycle upon  receipt
 33    of the new registration from the department.
 34        (5)  The military veteran motorcycle license plate shall be of a color and
 35    design:
 36        (a)  Iin  accordance  with the provisions of section 49-402C, Idaho Code.,
 37        except that In  addition,  there  shall  be  no  decals  to  indicate  the
 38        veteran's branch of service or the period of duty served; and
 39        (b)  Tthe  plate  shall  display  the  words "Scenic Idaho" at the top and
 40        "Veteran" at the bottom of the plate; and
 41        (c)  Tthe license plate design shall comply with all applicable  rules  of
 42        the  department,  and shall include a separate and distinct numbering sys-
 43        tem; and

  1        (d)  The design, color, be approved by the department and any  portion  of
  2        the  design  which represents veterans shall be acceptable to the veterans
  3        administration and a unique numbering system shall be subject to  approval
  4        of utilized by the department.
                                                                        
  5        SECTION  2.  An  emergency  existing  therefor,  which emergency is hereby
  6    declared to exist, this act shall be in full force and effect on and after its
  7    passage and approval, and retroactively to January 1, 2006.

Statement of Purpose / Fiscal Impact



                       STATEMENT OF PURPOSE

                            RS 15391C2

This legislation will amend Section 49-418D, Idaho Code, to allow
a graphic design to be placed on the veteran's motorcycle license
plate.  The existing code limits the plate's design to Idaho's
standard red, white, and blue plate, with the words "Scenic
Idaho" at the top and "Veteran" at the bottom.

This amendment will allow a graphic design to be placed on the
plate in order to come to a resolution with all interested
parties.  This plate was originally to be available for purchase
on January 1, 2005, but due to the lack of reaching agreement on
the plate design, it is necessary to amend this code in order to
produce the veteran's motorcycle license plate.

An emergency therefore exists and final plate design has reached
consensus, this legislation will allow a retroactive effective
date of January 1, 2006, to fulfill plate orders pending for the
past year.


                           FISCAL NOTE

This legislation does not require additional budget funding for
the department, as the license plate fees will be continuously
appropriated to the plate manufacturing account.
