1 AN ACT
2 RELATING TO SPECIAL MOTOR VEHICLE LICENSE PLATES; AMENDING SECTION 49-402,
3 IDAHO CODE, TO PROVIDE A CODE REFERENCE; AMENDING CHAPTER 4, TITLE 49,
4 IDAHO CODE, BY THE ADDITION OF A NEW SECTION 49-416D, IDAHO CODE, TO
5 ESTABLISH AN IDAHO STATE HISTORIC PRESERVATION SPECIAL LICENSE PLATE PRO-
6 GRAM; AMENDING CHAPTER 41, TITLE 67, IDAHO CODE, BY THE ADDITION OF A NEW
7 SECTION 67-4129B, IDAHO CODE, TO PROVIDE FOR THE CREATION OF AN IDAHO HIS-
8 TORIC PRESERVATION AND CULTURAL ENHANCEMENT FUND; AND PROVIDING AN EFFEC-
9 TIVE DATE.
10 Be It Enacted by the Legislature of the State of Idaho:
11 SECTION 1. That Section 49-402, Idaho Code, be, and the same is hereby
12 amended to read as follows:
13 49-402. ANNUAL REGISTRATION. (1) The annual fee for operating each pickup
14 truck, each neighborhood electric vehicle and each other motor vehicle having
15 a maximum gross weight not in excess of eight thousand (8,000) pounds shall
16 be:
17 Vehicles one (1) and two (2) years old ............................ $48.00
18 Vehicles three (3) and four (4) years old ......................... $36.00
19 Vehicles five (5) and six (6) years old ........................... $36.00
20 Vehicles seven (7) and eight (8) years old ........................ $24.00
21 Vehicles over eight (8) years old ................................. $24.00
22 There shall be twelve (12) registration periods, starting in January for
23 holders of validation registration stickers numbered 1, and proceeding consec-
24 utively through December for holders of validation registration stickers num-
25 bered 12, each of which shall start on the first day of a calendar month and
26 end on the last day of the twelfth month from the first day of the beginning
27 month. Registration periods shall expire midnight on the last day of the reg-
28 istration period in the year designated by the validation registration
29 sticker. The numeral digit on the validation registration stickers shall, as
30 does the registration card, fix the registration period under the staggered
31 plate system of Idaho for the purpose of reregistration and notice of expira-
32 tion.
33 A vehicle that has once been registered for any of the above designated
34 periods shall, upon reregistration, be registered for the period bearing the
35 same number, and the registration card shall show and be the exclusive proof
36 of the expiration date of registration and licensing. Vehicles may be ini-
37 tially registered for less than a twelve (12) month period, or for more than a
38 twelve (12) month period, and the fee prorated on a monthly basis if the frac-
39 tional registration tends to fulfill the purpose of the monthly series regis-
40 tration system.
41 (2) For all school buses operated either by a nonprofit, nonpublic school
42 or operated pursuant to a service contract with a school district for trans-
43 porting children to or from school or in connection with school approved

1 activities, the annual fee shall be twenty-four dollars ($24.00).
2 (3) For all motorcycles and all-terrain vehicles operated upon the public
3 highways the annual fee shall be nine dollars ($9.00). For operation of an
4 all-terrain vehicle or motorcycle off the public highways, the fee specified
5 in section 67-7122, Idaho Code, shall be paid. Registration exemptions pro-
6 vided in section 49-426(2), (3) and (4), Idaho Code, apply to all-terrain
7 vehicles and motorcycles used for the purposes described in subsections (2),
8 (3) and (4) of section 49-426, Idaho Code.
9 (4) For all motor homes the fee shall be as specified in subsection (1)
10 of this section and shall be in addition to the fees provided for in section
11 49-445, Idaho Code.
12 (5) Registration fees shall not be subject to refund.
13 (6) A financial institution or repossession service contracted to a
14 financial institution repossessing vehicles under the terms of a security
15 agreement shall move the vehicle from the place of repossession to the finan-
16 cial institution's place of business on a repossession plate. The repossession
17 plate shall also be used for demonstrating the vehicle to a prospective pur-
18 chaser for a period not to exceed ninety-six (96) hours. The registration fees
19 for repossession plates shall be as required in subsection (1) of this section
20 for a vehicle one (1) and two (2) years old. All other fees required under
21 chapter 4, title 49, Idaho Code, shall be in addition to the registration fee.
22 The repossession plate shall be issued on an annual basis by the department.
23 (7) In addition to the annual registration fee in this section, there
24 shall be an initial program fee of twenty-five dollars ($25.00) and an annual
25 program fee of fifteen dollars ($15.00) for all special license plate programs
26 for those license plates issued pursuant to sections 49-404A, 49-407, 49-408,
27 49-409, 49-414, 49-416, 49-418 and 49-418D, Idaho Code. For special plates
28 issued pursuant to sections 49-406 and 49-406A, Idaho Code, there shall be an
29 initial program fee of twenty-five dollars ($25.00) but there shall be no
30 annual renewal fee. For special plates issued pursuant to sections 49-416A,
31 49-416B, 49-416C, 49-416D, 49-417, 49-417A, 49-417B, 49-417C, 49-418A,
32 49-418B, 49-418C, 49-419, 49-419A, 49-419B, 49-419C, 49-419D, 49-420, 49-420A,
33 49-420B, 49-420C, 49-420D, 49-420E and 49-420G, Idaho Code, there shall be an
34 initial program fee of thirty-five dollars ($35.00) and an annual program fee
35 of twenty-five dollars ($25.00). The fees contained in this subsection shall
36 be applicable to all new special plate programs. The initial program fee and
37 the annual program fee shall be deposited in the state highway account and
38 shall be used to fund the cost of administration of special license plate pro-
39 grams, unless otherwise specified by law.
40 SECTION 2. That Chapter 4, Title 49, Idaho Code, be, and the same is
41 hereby amended by the addition thereto of a NEW SECTION, to be known and des-
42 ignated as Section 49-416D, Idaho Code, and to read as follows:
43 49-416D. IDAHO STATE HISTORIC PRESERVATION PLATES. (1) On and after Janu-
44 ary 1, 2007, any person who is the owner of a vehicle registered under the
45 provisions of section 49-402 or 49-434(1), Idaho Code, or registered under any
46 other section of law for which the purchase of special plates is allowed, may
47 apply for and, upon department approval, receive special Idaho state historic
48 preservation license plates in lieu of regular license plates. The provisions
49 of this section shall not apply to any vehicle with a registered maximum gross
50 weight over twenty-six thousand (26,000) pounds. Availability of Idaho state
51 historic preservation license plates for other vehicles shall be subject to
52 the rules, policies and procedures of the department.
53 (2) In addition to the regular registration fee required in chapter 4,

1 title 49, Idaho Code, the applicant shall be charged a fee of thirty-five dol-
2 lars ($35.00) for the initial issuance of plates, and twenty-five dollars
3 ($25.00) upon each succeeding annual registration. Ten dollars ($10.00) of the
4 initial fee and ten dollars ($10.00) of the renewal fee shall be deposited in
5 the state highway account and shall be used to fund the cost of administration
6 of this special license plate program. Twenty-five dollars ($25.00) of each
7 initial fee and fifteen dollars ($15.00) of each renewal fee shall be trans-
8 ferred by the state treasurer to the Idaho historic preservation and cultural
9 enhancement fund created in section 67-4129B, Idaho Code, and shall be used by
10 the state historical society to protect and preserve the heritage and cultural
11 resources of the state.
12 (3) Whenever title or interest in a vehicle registered under the provi-
13 sions of this section is transferred or assigned, the owner may transfer the
14 special plates to another vehicle upon payment of the required transfer fees.
15 The owner may only display the plates on another vehicle upon receipt of the
16 new registration from the department.
17 (4) The Idaho state historic preservation license plate shall be of a
18 color and design in accordance with the provisions of section 49-402C, Idaho
19 Code. The design and any slogan on the plate shall be acceptable to the direc-
20 tor of the state historical society and shall be approved by the Idaho trans-
21 portation department utilizing a numbering system as determined by the depart-
22 ment. Initial costs of the plate program, including costs of plate design,
23 shall be paid by the state historical society.
24 (5) Sample Idaho state historic preservation license plates may be pur-
25 chased for a fee of thirty dollars ($30.00), ten dollars ($10.00) of which
26 shall be deposited in the state highway account and twenty dollars ($20.00) of
27 which shall be transferred to the Idaho historic preservation and cultural
28 enhancement fund for protection and preservation of the state's cultural
29 resources, historic buildings, structures, artifacts, and records; for
30 enhancement of statewide cultural and historic education opportunities; and
31 for historical research purposes.
32 SECTION 3. That Chapter 41, Title 67, Idaho Code, be, and the same is
33 hereby amended by the addition thereto of a NEW SECTION, to be known and des-
34 ignated as Section 67-4129B, Idaho Code, and to read as follows:
35 67-4129B. IDAHO HISTORIC PRESERVATION AND CULTURAL ENHANCEMENT FUND. (1)
36 There is hereby created in the state treasury the Idaho historic preservation
37 and cultural enhancement fund. Moneys in the fund shall consist of funds
38 received pursuant to section 49-416D, Idaho Code, grants, federal moneys,
39 donations or funds from any other source.
40 (2) Moneys in the fund may be expended pursuant to appropriation to the
41 state historical society and the fund balance may be appropriated annually to
42 the state historical society. The state treasurer shall invest all idle moneys
43 in the fund. Any interest earned on the investment of idle moneys shall be
44 returned to the fund.
45 (3) Moneys in the fund shall be used exclusively for the purposes of pro-
46 tection and preservation of the state's cultural resources, historic build-
47 ings, structures, artifacts, and records; for enhancement of statewide cul-
48 tural and historic education opportunities; and for historical research pur-
49 poses.
50 SECTION 4. This act shall be in full force and effect on and after Janu-
51 ary 1, 2007.
STATEMENT OF PURPOSE
RS 15401
The proposed legislation recognizes the state's continuing
obligation to protect and preserve its heritage and cultural
resources by establishing a dedicated fund for use in the
statewide preservation of cultural resources, historic buildings,
structures, artifacts, and records, enhancement of statewide
cultural and historic education opportunities, and historical
research purposes and by amending the existing special motor
vehicle license plate program to include the Idaho State Historic
Preservation license plate.
FISCAL NOTE
There would be no impact on the state's general fund. It is
anticipated that the sale of license plates would generate
approximately thirty thousand dollars ($30,000) of revenue to the
ISHPACE fund.
